Will of John Brennock

Last Will and Testament of
John Brennock of Petty Harbor Road
Farmer deceased.

      This is the last will and testament of me John Brennock of Forest Pond near Petty Harbor in the Island of Newfoundland Farmer made this twenty sixth day of January in the year of our Lord one thousand eight hundred and ninety one.

First I devise and bequeath to my grandchild Mary Elizabeth Brennock all the farm or property situate near Forest Pond purchased by me from one Richard Williams and at present occupied by Sarah Brennock also all that property situate at Forest Pond aforesaid on the South west side of the road and purchased by me from one James and William Doyle. The said properties to be held by the said Sarah Brennock and my executor hereinafter named in Trust for my said Grandchild till she arrives at the age of twenty five years when she is to receive an absolute assignment of the same and the rents profits and issues arising out of the said land until she arrives at the said age is to be applied to her maintenance and support.

Second I give devise and bequeath unto my son John Brennock all that property or farm at present occupied by me situate near at Forest Pond aforesaid and purchased by me from Daniel Oneil and the condition of this bequest to my said son John is that whilst my daughter Ellen Brennock remains unmarried my said son John shall support her and give her the use of my said house and premises as long as she shall desire to remain in the same and the further condition of the above bequest to my said son John is that he shall keep and support and rear my little Grandchild Mary Agnes Everell as long as she shall remain single and unmarried. I give devise and bequeath all the farm furniture and stock on the said farm to my said son John save and except what Sarah Brennock may have in her possession which I hereby leave to the said Sarah Brennock. Also all the furniture in my said house I leave to my said son John.

Third I give and bequeath to my daughter Ellen Brennock the sum of one hundred pounds now in the Union Bank.

Fourth. I give and bequeath to my children John & Mary wife of Lawrence Brown and my two Grandchildren Mary Agnes Everell and Mary Elizabeth Brennock the sum of one hundred dollars each to be paid them out of the four hundred dollars due by Samuel Ruby to me under mortgage. My executor hereinafter mentioned shall hold the said sums of money bequeathed to my said Grandchildren in trust for them till they arrive at the age of twenty one years.

I hereby appoint the Honorable E. P. Morris Executor of this my will. In testimony whereof I have hereunto subscribed my hand by affixing my mark at St. John's aforesaid the day and year first above written. (Sgd) John his X mark Brennock. Signed by the said Testator by affixing his mark as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses the same having been first read over and explained witness (sgd) E. P. Morris (sgd) John Stapleton. -

This is a codicil to the last will and Testament of me John Brennock at present of Forest Pond, Farmer which said will bears date the 26th day of January A.D. 1891. My Grand daughter Mary Agnes Everell having died since, since my said will was made I desire to cancel and revoke all that portion of my said will which refers to her. Further I wish to add as a condition to the bequest of the farm left to my son John that should my said daughter Ellen whilst she remains single desire to leave my house and reside elsewhere, my said son John shall allow her and pay over to her annually the sum of forty dollars per year whilst she remains single as aforesaid and away from the said house
And further the sum of money left my said Granddaughter deceased under my said will I give and bequeath to my said daughter Mary Byrne. In all other respects I confirm my said will.
In witness whereof I the said testator hereby sign the said as and for a codicil to my said will., this 12th day of October A.D. 1892. (Sgd) John Brennock. (Sgd) Patrick Murphy. (Sgd) E. P.. Morris
