Will of David Brine
from Newfoundland will books volume 11 page 531 probate year 1920

In re David Brine       deceased

This is the last will and Testament of me David Brine, of St. John's in the Island of Newfoundland, Laborer.

  • I revoke all former wills by me at any time made, and I appoint my stepson, Michael Miller, the Executor of this my will.
  • I will and direct that my just debts and my funeral and testamentary expenses shall be first paid out of my estate.
  • I give and bequeath to Patrick Miller, son of my stepson James Miller, on his attaining the age of twenty one years the sum of two hundred and eighty dollars.
  • I give and bequeath to my said stepson Michael Miller for his own use absolutely all the rest and residue of whatsoever property I may die possessed, including in particular my leasehold messuage No. 50 Signal Hill Road and all the household furniture and effects therein contained, and also any cash remaining in Bank or on hand after the payment of my funeral and testamentary expenses and the bequest to Patrick Miller hereinafter mentioned.
  • In the event of the said Patrick Miller dying before attaining the age of twenty one years then and in such case the said sum of two hundred and eighty dollars and all interest thereon shall go to my said stepson Michael Miller.

In witness whereof I have hereunto subscribed my hand at St. John's aforesaid this tenth day of May A.D. 1920.     David his X mark Brine

Signed Published and Declared by the Testator as and for his last will and Testament in presence of us, both being present at the same time who at his request and in his presence hereunto subscribe our names as witnesses attesting the due execution hereof, the same having been first read over and explained to the Testator who appeared perfectly to understand the same and who signed the same by making his mark thereto in our presence.    John Walsh.    W. Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
