Will of John Broom
from Newfoundland will books volume 1 pages 213 & 214 probate year 1835

In re
     John Broom       deceased.

In the Fear of God Amen. I John Broom late of the Town and County of Peel in Dorsetshire England but now residing in St. John's Nfld do make this my last will and testament as follows vizt. I give and bequeath all my real and personal estate of what nature and kind soever unto my friends David Buchan Esqr High Sheriff and unto John Bickley Garland of Trinity and St. John's Esquire Merchant both residing at Newfoundland aforesaid In Trust to be disposed of by them their heirs or administrators as hereinafter mentioned That is to say First my will is that my just debts and funeral expenses be paid and that they as soon as convenient dispose by public auction or otherwise all my personal property of what nature and kind soever the lands and other property hereinafter mentioned excepted and the net produce of the same and all disposable moneys to be put out at interest on good security in st. John's as my said Trustees may see proper And I give and bequeath unto my son George Broom and my daughters Mary Williams Susan Ann Hogsett and Sarah Bonifant all my property that I may die possessed of share and share alike That part that may fall to my daughters to be to their individual use and behoof independent of their present covertures or any future coverture their receipts under their own hands or the hands of their several attorneys only to be an acquittal to any tenant that may be occupancy of houses or lands or of any moneys at interest by bond or mortgage and not otherwise And at the expiration of two years after my decease the whole to be divided to each share and share alike as aforesaid by lot or otherwise as my executors may think proper to be sanctioned by the Chief Judges of the Supreme Court for the time being. And I hereby appoint the aforesaid David Buchan and John B. Garland Esquires executors to this my last will and testament revoking all former wills by me made.
In witness whereof I have hereunto set my hand and seal at St. John's aforesaid this ninth day of November in the year of our Lord one thousand eight hundred & thirty two. John Broom (LS)
Signed sealed and delivered as the last will and testament of the testator in the presence of us the subscribing witnesses, Geo. Lilly, Not. Pub.

In the Fear of God Amen. I John Broom do make this codicil of the foregoing will & testament and in the stead of John Bickley Garland aforesaid now residing in England I hereby appoint my friend Thomas Bennett Esquire Speaker of the Local House of Assembly my executor of the foregoing will & testament jointly with David Buchan Esqr high Sheriff aforesaid. In witness whereof I set my hand & affix my seal at St. John's Nfland aforesaid this first day of November in the year of our Lord one thousand eight hundred and thirty four. John Broom (LS)

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
