Last Will and Testament of
Samuel Brown of Salvage
Fisherman deceased.
This is the last will and Testament of me Samuel
Brown of Salvage, Fisherman I give devise and bequeath to my executor hereinafter
named all the property moneys goods debts and effects of every nature and kind
of which I may die possessed (save and except the bequest hereinafter mentioned
to my wife Emily) in trust as follows:- First the landed property
on which I now reside, together with the house in which I live, for the use
of my wife Emily until her death or re-marriage whichever shall first occur,
my son Charles Bendell Brown to be entitled to reside with her in the same
house until he attains the age of twenty one years or marries and after for
so long a time as my said wife shall desire. Second the remainder
of my property of every kind for the support and maintenance of my wife Emily during her lifetime or so long as she remains a widow, and my son Charles
Bendell Brown until he shall have attained the age of twenty one years Third
In the event of my said wife Emily remarrying or dying during the lifetime
of my said son Charles Bendell Brown all the property moneys goods debts and
effects of or belonging to me of every nature and kind shall be administered
by the executor for the support and maintenance of my said son Charles
Bendell Brown until he attains the age of twenty five years and then be assigned to
him for his use for life or until the birth of lawful issue of him, and then
be assigned to him as his sole and absolute property upon the birth of such
lawful issue. Fourth. In the event of my said son Charles Bendell
Brown dying without issue during the lifetime of my said wife Emily, the said
property moneys goods debts and effects on her decease or remarriage to be
divided equally between my brothers James John and Henry. Fifth.
In the event of my said wife Emily dying during the lifetime of my said son
Charles Bendell Brown, or remarrying and my said son Charles
Bendell Brown dying before he attains the age of twenty five years, without issue, the moneys
goods debts and effects shall be divided equally between my said brothers James
John and Henry. Sixth. In the event of my said wife Emily remarrying
or dying, after the death of my said son Charles Bendell Brown, and before
he attains the age of twenty five years, if there should be issue of my said
son Charles Bendell Brown living at the time of her death or remarriage, all
the said property moneys goods debts and effects shall be assigned on her remarriage
or death to the said issue of my said son Charles Bendell Brown and in the
event of my said son dying before he attains the age of twenty five years and
there being no issue of my said son surviving at the time of the death or remarriage
of my said wife Emily, the said property moneys goods debts and effects shall
be equally divided between my said brothers James, John and Henry. To
my beloved wife Emily I give and bequeath the sum of two hundred dollars for
her sole and separate use. I appoint Kenneth Brown of Salvage Fisherman Executor
and Trustee of this my will. St. John's June 22 Anno Domini one thousand
nine hundred. (Sgd) Samuel Brown. Signed by the said Testator as and for his
last will and Testament in the presence of us who in his presence at his request
and in the presence of each other have hereunto subscribed our hands as witnesses. (Sgd)
