Will of Denis J. Burke, from Newfoundland will books volume 15 pages 398 & 399 probate year 1931

Denis J. Burke.

This is the last Will and Testament of me, Denis J. Burke, of St Jacques in the Island of Newfoundland, Merchant made this Eleventh day of May A.D. 1922.

  1. Being of sound mind and memory I hereby appoint Thomas J. McCarthy to be the executor of this, my will.
  2. I give, devise and bequeath unto my son, John M. J. Burke unconditionally my half interest in the firm of D.J. and T. Burke, and also my stock in the Newfoundland, New York and Halifax Steamship Company amounting to face value of £200 and registered in the name of John Burke, on the records of the Company.
  3. I direct that my dwelling house and grounds situate at St Jacques be held by my wife and children during her lifetime and after her death said dwelling and grounds shall become the property of my two children John M.J. and Kathleen Burke, and should Kathleen marry, my son John M. J. Thereupon becomes the sole owner of the aforesaid dwelling house and grounds.
  4. I direct that the rest and residue of all my personal and real estate is to be held by my wife Hettie Burke during her lifetime, provided that no person benefits thereby either directly or indirectly except herself and my two children John M.J. and Kathleen Burke and after her death the balance of my personal and real estate, other than those mentioned in sections 2 and 3 is to be divided equally between my two children John M.J. and Kathleen Burke.

In witness whereof I have hereunto set my hand the day and year first above written.

Signed published and declared by the above named Denis J. Burke, as and for his last will and testament in the presence of us, both being present at the same time who at his request and in his presence have hereunto subscribed our names as witnesses.

This is a codicil to the will made by me Denis J. Burke merchant of St Jacques in the Island of Newfoundland, on the eleventh day of May nineteen hundred and twenty two.

  1. I give to my daughter Kathleen M. Burke a sum equal to one third of the proceeds of my Policy of Life Insurance No 53,358 in the Crown Life, and direct the payment of this amount as soon as my will is probated.
  2. House mentioned in section 3 of said will is to be construed as meaning house and furniture.
  3. My half interest in the firm of D.J. and T. Burke having become the firm of D.J. Burke, the interests which constitute the said business shall be. The premises, stock in trade, schooners, dock debts, mortgage and shares of stock of whatsoever kind and also, any interest I may still have in the unliquidated assets of D.J. and T. Burke. These I give to my son John M.J. Burke.
  4. In all other respects I hereby confirm the said will.

In witness whereof I have hereunto set my hand this First Day of February in the year of our Lord nineteen hundred and thirty one.
