Last will and testament
of James Byrne
of St. John's Tidewaiter Deceased.

This is the last will and testament of me James Byrne of St. John's in the Island of Newfoundland Tidewaiter. I hereby revoking all former wills and testamentary dispositions by me at any time made. First I give devise and bequeath that land with the five dwelling houses thereon situate on the north side of New Gower Street St. John's unto my wife Catherine Byrne during her lifetime to receive and take the rents issues profits and advantages arising therefrom for her support and maintenance. Second upon the decease of my said wife I give devise and bequeath the aforesaid land and premises absolutely and forever unto my son Patrick Byrne save and except the eastern house of the aforesaid dwelling houses which I give and bequeath unto my daughter Fanny Kehoe during her lifetime and upon the decease of the said Fanny Kehoe I give and bequeath the same absolutely to my son Patrick Byrne. Third. I give devise and bequeath all my right title and interest in and to the leasehold land and premises situate on Duckworth Street unto my wife Catherine Byrne. Fourth. I give and bequeath all my household furniture goods chattels and effects of every kind and description unto my wife Catherine Byrne. Fifth. I give and bequeath unto my son John Byrne the sum of four hundred dollars Sixth I give and bequeath unto my ???? Byrne the sum of four hundred dollars Seventh. I give and bequeath unto my son Patrick Byrne the sum of four hundred dollars. Eighth. I give and bequeath unto my daughter Bridget Burke the sum of four hundred dollars. Ninth. I give and bequeath unto my daughter Fanny Kehoe the sum of four hundred dollars. Tenth. All moneys in Bank or elsewhere at the time of my decease after payment of my debts funeral and testamentary expenses and all the rest residue and remainder of my estate of every description I give devise and bequeath absolutely and forever unto my wife Catherine Byrne whom I nominate and appoint executrix of this my last will. James Byrne. Signed by the said James Byrne this 25th day of September A.D. eighteen hundred and eighty nine in the presence of us F. G. Bunting F. E. W. Bunting.
I certify the foregoing to be a correct copy of the last will and testament of James Byrne Deceased.
