Last will and Testament of
Thomas Cleary of Bay Roberts N. D.
Fisherman deceased

      The last will and testament of Thomas Cleary Farmer of Bay Roberts, Conception Bay Newfoundland. In the name of God Amen I Thomas Cleary being now sick in bodily health but of perfect mind, do make my last will and Testament I give and bequeath to my five sons, Thomas, Patrick Richard, William and Daniel twenty acres of land (called the inside land) to be divided equally amongst them. Out of fourteen acres of land called the outside land I give to my said sons Thomas, Patrick, Richard William and Daniel Cleary two acres each. The remaining four acres I give to my wife Anastatia Cleary and my son Michael Cleary to be divided equally amongst them. To my son Thomas Cleary I give the small garden to the east of my dwelling house. I give my dwelling house to my sons Thomas and William: but my wife is to have a room in said dwelling house. My cellar is to be included with the dwelling house.
And I give to my wife Anastatia my two kitchen gardens, the produce of which is to be in common with the family in the house. If the dwelling house be removed the ground on which it stands and around it is to be included with the kitchen garden near the house. None of the land is to be sold to any stranger unless all parties be satisfied. If my sons Michael, Patrick and Richard who are now away do not return to claim their shares, said shares are to be divided equally between my sons Thomas, William and Daniel Cleary.
In witness whereof we have put our hands this eighth day of July in the year of our Lord one thousand eight hundred and eighty seven. Being first read over to and signed by the Testator Thomas Cleary (sgd) Thomas his X mark Cleary. Witness (sgd) James his X mark O’Neil (sgd) Patrick Haberlin. Executor Patrick Haberlin
