In re DECEASED.
THOMAS B. CLIFT.
I, Thomas B. Clift of St. John's, in the Dominion of Newfoundland, Commission
Merchant, hereby revoke all testamentary dispositions heretofore made by me
and declare this to be my last will.
- I appoint my son Thomas Shannon Clift, and my daughter Lavinia
Clift Executor and Executrix and Trustees respectively of this
my will.
- I devise and bequeath unto my wife Elizabeth Clift for
her life all my land with Dwelling House and all other erections thereon
situate on LeMarchant Road, together with all household furniture and effects
contained in said Dwelling house (other than as hereinafter provided when
at her death I devise and bequeath said land with dwelling house and all
other erections thereon, household furniture and effects unto my daughter Lavinia,
absolutely.
- I devise and bequeath unto my daughter Lavinia, absolutely;-
(A) all my interest in the rentals from my late fathers estate.
(B) the whole of the chattels and effects in or about and used in connection
with my stable such as live stock, carriages, sleighs, harness and other
moveable goods.
(C) my piano, book case and all books contained in said book case situate
in my dwelling house.
(D) my watch with gold face.
(E) my gold nugget tie pin.
- I devise and bequeath unto my son Thomas Shannon
Clift, absolutely.
(A) one-half of all my interest in the Brokerage Business now carries on
by me.
(B) my silver watch.
(C) my gold watch and chain which is now used by me.
(D) my diamond ring.
(E) all my clothing.
- I devise and bequeath unto my Trustees the remaining
one-half interest of my said Brokerage Business from which Business I direct
my Trustees to pay to my said wife Elizabeth Clift during
her lifetime a yearly income of Two Thousand dollars, or so much as said
business shall earn net in excess of two thousand dollars to be arranged
by my trustees and paid at the convenience of the business, but any earnings
from said remaining one-half of said business in excess of two thousand dollars
per year I bequeath unto my son Thomas Shannon Clift absolutely.
At the death of my said wife
Elizabeth Clift I devise and bequeath said remaining one-half
interest of my said Brokerage Business unto my son Thomas Shannon
Clift absolutely.
- I devise and bequeath to my wife Elizabeth Clift,
absolutely my small gold watch with chain and my Silver Handled Walking Stick.
- I
devise and bequeath unto Edward Knight my gold cuff links.
- I
direct my trustees to appropriate the rent accruing from the lease of my
stable and to apply the same to the payment of the ground rent on my said
land with dwelling house thereon and to apply any balance to the upkeep of
my said dwelling house and property.
- I devise and bequeath the following
pecuniary legacies;-
(A) to the Newfoundland Diocesan Synod Fifty Dollars.
(B) to the Church of England Orphanage Fifty Dollars.
- I devise and bequeath
unto my Stenographer Miss Josephine Ryan, absolutely, the
sum of Two Hundred & fifty
Dollars.
- I devise and bequeath unto Philip Tucker, absolutely,
if in my service at the date of my death, the sum of one hundred dollars.
- I
devise and bequeath all the residue of my estate and effects unto my daughter
Lavinia, absolutely.
IN WITNESS WHEREOF I have hereunto subscribed
and set my hand at St. John's this 13th day of January A.D.
