SAMUEL CLUNEY.

The Last Will and Testament of Samuel Cluney
This is the Last Will and Testament of me Samuel Cluney of Topsail Road in the electoral district of St John's West Extern, farmer.
I hereby revoke all former wills made by me. I hereby appoint Philip J. Lewis of St John's Solicitor to be sole executor of this my will and empower him to charge all fees for professional services done done in regard to the finalization of my estate and the probating of my will. My land and house situate at Kane's Valley Topsail Road I devise and bequeath as follows. To my wife Susanna I leave half the said dwelling house and land absolutely forever the other half I devise and bequeath absolutely to my son Ronald. Provided however that should Ronald die without male issue the said gift to him shall vest in his wife Doris but she is not to remarry and bring another man on the place. She may sell her share if she wishes to do so but must on no account bring another man in. I devise half my cattle namely four cows to my wife Susanna the other four I leave to my son Ronald.
I leave my horse "Tuscan" to Ronald and also my express. I also leave him my farming implements to work the place. I devise to Ernest Somerton a strip of land being five acres of that piece of my property situate on the eastern side of the main road at Kane's Valley aforesaid. This Five acres shall be taken from the eastern side of the said land and will be a strip running from the main road to the river. I bequeath to my oldest daughter Amy the sum of $100.00. I also bequeath $100.00 to my daughter Bridget. This bequest is made subject to the provision that I have this much cash on hand at my death if I have not the rest of my estate shall not be charged with the said bequest. The said bequests shall be paid proportionately however if the full amount is not on hand I bequeath to my wife Susanna all my monies and securities for monies absolutely after payment of my funeral expenses and testamentary expenses and the above bequests.
I bequeath one suite of my furniture to my wife the other to my son Ronald. The other household effects I give as follows one half to my wife Susanna one half to my son Ronald. In case of any dispute between the parties entitled under my will to the parts to which they or each may be entitled I empower my executor to make the distribution and his choice as to the articles ????? to be given to each shall be final. I empower my executor to dispose of my land and house at Kelligrews and I further empower him to divide the proceeds equally between among my wife Susanna and my children Ronald, Amy and Bridget.
All the rest and residue of my property wherever situate and of whatsoever kind not hereinbefore disposed of I devsie and bequeath to my wife Susanna absolutely.
