Will of Michael Comerford
from Newfoundland Will Books volume 7 pages 356 & 357 probate year 1904

The last will of Michael Comerford of Boston U.S.A. Letter Carrier deceased

Be it remembered that I, Michael Comerford now of Boston in the Commonwealth of Massachusetts and late of St. John's, Newfoundland in the British Provinces being of sound and disposing mind and memory but knowing the uncertainties of this life do make this my last will and testament hereby revoking and making null and void all other wills by me heretofore made.

  • Item First. my will is that all of my just debts and funeral charges shall by my executrix herein after named be paid out of my estate as soon after my decease as shall be found convenient.
  • Item Second, I hereby nominate and appoint my niece Catherine M. J. Sherritt of Boston in the Commonwealth of Massachusetts to be the executrix of this my last will and testament and that she be exempt from giving a surety or sureties on her official bond.
  • Item Third I give bequeath and devise to my niece Catherine M. J. Sherritt of Boston and Commonwealth of Massachusetts my both tenements and houses and lands hereto and all the appurtenances to said tenement houses situated nos 87 and 89 Gower Street in St. John's, Newfoundland, to her own use and her heirs and assigns forever.
  • Item Fourth, All the rest residue and remainder of my estate both real personal and mixed of which I may die possessed of or which I may be entitled to at my decease I give bequeath and devise to my niece Catherine M. J. Sherritt for her own use and her heirs and assigns forever.

In testimony whereof I hereunto set my hand and seal in the presence of these witnesses and declare this to be my last will and testament, this 9th day of December 1903 Michael Comerford (LS) Signed sealed published and declared by the above named Michael Comerford as and for his last will and testament in the presence of us and in the presence of each other have subscribed our names as witnesses thereto. Jeremiah J. Mahoney     Edward P. Morton     Daniel F. Mahoney.

I certify the foregoing to be a correct copy of the last will of Michael Comerford.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We, who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
