Will of James Dunne, from Newfoundland will books volume 15 pages 445 & 446 probate year 1931

James Dunne.

This is the last will and testament of me James Dunne St. John's Newfoundland retired furniture restorer and I revoke all former wills by me made. I appoint and nominate my daughter Alice Dunne and T. Scanlan McGrath Solicitor executors and trustees of this my will.
I give and bequeath my house and all my land situate on the south side of Catherine Street to my daughter Anne and my son James in equal shares as tenants in common for ever. I give and bequeath the dwelling house I now reside in and all the land appurtenant thereto and enjoyed therewith including the triangular garden adjoining the same on the south all of which is situate on the east or northern side of Hayward Avenue to my daughter Alice forever. I give and bequeath the dwelling house adjoining on the north the house I now live in and now numbered 6 with all the land appurtenant thereto and there under to my son Harry and my daughter Maggie in equal shares as tenants in common for ever and I make this bequest upon the condition that should my said son Harry or the said daughter Maggie cease to occupy the dwelling and premises hereby given the outgoing co-owner shall not rent or sell his or her interest in this bequest without the approval of the co-owner continuing in occupation and upon the further condition that the said owner continuing in occupation shall have a first option to rent or purchase as the case may be the interest of the outgoing co-owner if that party at any time desires to rent or sell his or her interest. I give and bequeath to my son James a portion of the land I purchased from Margaret Snow on the 15th day of February 1919 and registered in volume 63 folios 509-511 of the Registry of Deeds for Newfoundland which said portion is the major southern portion of the said land and measures one hundred and forty three feet on the south and is bounded on the west by a narrow lane by which it measures fifty six feet on the north by the remainder of the land I bought from Margaret Snow and on the east by the right of way referred to in the deed from Margaret Snow by which it measures fifty six feet together with all buildings and erections thereon. I give and bequeath to my son Harry the remainder of the said land I bought from said Margaret Snow together with all the buildings thereon. My said sons James and Harry are to have the benefit of the said right of way subject to the rights of others to use the same as mentioned in the said deed from the said Margaret Snow in which deed there is a plan attached showing all this land and the said right of way. I give and bequeath to my said son James the horses, cart and harness and other utensils and equipment that is now used by him absolutely. I give and bequeath to my grandson William Murphy the carts and harness and other utensils and equipment excepting horse which articles have been given recently used by him absolutely. I give and bequeath to my said daughters Anne and Maggie one hundred dollars each. I give and bequeath the rest, residue and remainder of my estate to my said daughter Alice absolutely.
The said T. Scanlan McGrath shall be paid for his professional services.
In witness whereof I have hereunto subscribed my hand this 29th day of April one thousand nine hundred and thirty one.
