AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of John Kelly late of Saint John's in the Central District of Newfoundland, Blacksmith, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said John Kelly, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Three Thousand Five Hundred Dollars.

So help you God.

The Petition of Ellen Kelley of St. John's in the Island of Newfoundland, Widow,

Humbly Sheweth

          That Petitioner's husband John Kelley, late of St. John's, Blacksmith, deceased died on the 29th day of July A.D. 1886 having first made and executed the paper writing hereto annexed as and for his last Will and Testament.
          That the said will has been duly proven.
          That your Petitioner is appointed sole Executrix under the said Will.
          That deceased at the time of his death was possessed of property of the probable value of Three Thousand Two Hundred Dollars.

          Your Petitioner therefore prays that she may be granted Probate to the said Will
          And as in duty bound &c.

SUPREME COURT OF NEWFOUNDLAND

ST. JOHN'S }
TO WIT       } Frederick E. M. Bunting of St. John's, Newfoundland, Barrister at Law, maketh oath and saith that on the twenty ninth day of July A.D. one thousand eight hundred and eighty six at St. John's aforesaid he, this Deponent, was present and did see John Kelley, late of St. Johns, Blacksmith, the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Richard Bourke of St. John's aforesaid, Cabinet Maker, the other subscribing witness thereto. That Deponent and said Richard Bourke then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other - That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of Deponent and the said Richard Bourke and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

aforesaid, this 3rd day of August
A.D. One Thousand Eight Hundred
and Eighty six.

This is the last will and testament of me, John Kelley of St. John's, Blacksmith, I here revoking all former wills by me made.

I give, devise and bequeath to my wife Ellen Kelley all and every description of property of which I die possessed consisting of three dwelling houses on the Marsh in St. John's and also all moneys that may be in the Banks at the time of my decease and also all Book debts owed me and generally all other description of property including household furniture and effects  and all stock in trade and tools in forge to have and to hold absolutely for her sole use, benefit and support. And I appoint my said wife, Ellen Kelley, Sole Executrix of this my last will and testament.
St. John's, Newfoundland, this 29th day of July A.D. 1886.
