AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of John Richards, late of Harbor Grace in the Northern District of Newfoundland, Cooper.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said John Richards, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of One Thousand Dollars.

So help you God.

Notice

          Three days after the date hereof, application will be made to the Honorable the Supreme Court for Probate to the last will and testament of John Richards, late of Harbor Grace, Cooper, deceased, to be granted to James Bransfield of Carbonear, Cooper, Planter, and Mary Richards of Harbor Grace, widow, the Executors named in said will.

Donnelly of Saint John's ___________in the Central District of the Island of Newfoundland maketh oath and saith that he freely and voluntarily renounces all rights to act as Executor of the last Will and Testament of John Richards, late of Harbor Grace, Cooper, deceased, and that he has in no way intermeddled with the affairs of the said Estate.

Andrew Drysdale of Harbor Grace aforesaid, Notary Public, one of the subscribing witnesses to the last Will and Testament of John Richards, late of Harbor Grace aforesaid, Master Cooper, deceased, maketh oath and saith that on the fifteenth day of January in the year of Our Lord one thousand eight hundred and seventy three he was personally present and did see the said Testator, John Richards, duly sign, seal and execute his said Last Will and Testament in the presence as well of the other subscribing witness thereto, F. J. McCarthy, as of this deponent, by writing his name and affixing his seal thereunto and that at the same time the said John Richards did duly publish and declare the said Will as his last will and testament and this deponent and the other said subscribing witness did duly sign their namesas witnesses thereto in his presence and in the presence of each other. That at the time of the signing, sealing execution and publication aforesaid of his said last will and testament by him, the said John Richards, he the said John Richards was of sound and disposing mind and memory and understanding.

This is the last Will and Testament of me, John Richards of Harbor Grace, Master Cooper, being of sound and disposing mind, memory and understanding.
          First. I give, devise and bequeath all these, my Dwelling Houses and lands, situate lying and being in Harbor Grace - that is to say the Dwelling House at No. 63 on the south side of Water Street and the Dwelling House at No. 70 on the north side of Water Street and all that Dwelling House and Cooper Shop, No. 10 on the south side of Holbrook Street unto my Wife, Mary Richards, her heirs and assigns for ever, towards her support and maintenance and also that of her Neice (sic) Margaret Bransfield whilst she remains unmarried.
Second. I give, devise and bequeath all that Dwelling House and land with its appurtenances situate in Harbor Grace No. 54 on the North side of Water Street to my Wife Mary Richards towards her support and maintenance and also that of her Neice (sic) Margaret Bransfield whilst she remains unmarried. And in the event of the said Dwelling House and land not having been sold or otherwise disposed of for the purposes aforesaid, at the time of the death of my said Wife Mary Richards then, and in that case, I give, devise and bequeath the same from and immediately after her death to her Neice (sic) Margaret Bransfield whilst she remains unmarried from and immediately after I give, devise and bequeath the same to my Neice (sic) Margaret Dalton now residing at St. John's, for and during her natural life and from and immediately after her death, I give, devise and bequeath the same to my Nephew James Richards now residing at Portland, United States, his heirs and assigns for ever.

 

Third. And I do hereby declare and publish that it is my will and desire that at any time my said wife Mary Richards may require for her better support and maintenance and also that of her Neice (sic) Margaret Bransfield, she my said Wife Mary Richards is hereby fully authorized and empowered to sell and dispose of all and singular my said Dwelling Houses, Cooper Shop and land, and that sale or other disposal shall be as valid and as good as if the said John Richards did sell and convey the same any thing herein contained to the contrary not have ?? standing.
Fourth. I give and bequeath all my stock in trade and all and every my household goods, furniture effects and Chattles (sic) and all other property wheresoever or whatsoever nature or kind so ever the same may be at the time of my death unto my Wife Mary Richards, her heirs and assigns.
And I do hereby make, ordain, constitute and appoint the Honle W. J. S. Donnelly and James Bransfield Executors of this my last Will and Testament and my Wife Mary Executrix of the same, hereby revoking all former and other Wills and Testaments by me at any time heretofore made.
In witness whereof, I the said John Richards, have to this my last Will and Testament set and subscribed my hand and seal this the 15th day of January in the year of Our Lord One thousand eight hundred and seventy three.

The Petition of James Bransfield of Carbonear, Planter and Mary Richards of Harbor Grace, Widow

Humbly Sheweth

That John Richards, late of Harbor Grace aforesaid, in the Northern District of the Island of Newfoundland, Master Cooper, deceased, died at that place in the month of April Anno Domini one thousand eight hundred and eighty one having previously made and left his Last Will and Testament which is hereunto attached and duly proved, whereof he appointed the Honorable W.J.S.  Donnelly and your Petitioner, executors and executrix. That the said Honorable W. J. S. Donnelly has duly renounced the executorship of said Will as is certified by the due renunciation of the said Honorable W. J. S. Donnelly hereunto attached.
          That your Petitioners therefore pray that Probate of the said last Will and Testament of the said John Richards may be granted unto them, And as in duty bound they will ever pray &c.
