Be it remembered, That on this     Eighteenth    day of   May       in the                   year of the reign of our Sovereign Lady VICTORIA, by the Grace of God of the United King- dom of Great Britaon and Ireland, Queen, Defender of the Faith, &c., and in the year of our Lord One Thousand Eight Hundred and

Personally appeared Henry Elms, of Bay Roberts in the northern District of newfoundland Fisherman Samuel Russell of so??     ?? ?elnam ??          and William Elms of same place fisherman

and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, Her Heirs and Successors, in the penal sum of   Twelve hundred pounds,dollars of good and lawful money of Great Britain-the Island of Newfoundland to be had, made and levied on their Goods, Chattels, and Effects, jointly and severally, if default is made in any of the conditions following :

 

Now the Condition of this Obligation is such That if the above bounden Henry Elms------------------------------- shall duly and faithfully act as Guardian of the Estate and Effects of Jacob Elms, Mary Elms, Sarah Patience Elms, Henry Elms and George Elms ------------------- all of Bay Roberts ?eforesaid a Minors under the age of twenty-one years, and shall and do pay and dispose of such Estate in such a manner as the said Court shall direct, then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

To the Honourable the Supreme Court on Circuit at Harbor Grace

The Petition of Henry Elms of Bay Roberts Fisherman

Humbly Sheweth

          That Henry Elms Senior late of Bay Roberts Fisherman deceased made and Executed an Afignment of certain land and premises to Petitioner upon certain trusts and conditions as by reference to the said Afignment which is hereto annexed will fully appear
          That there are five children of Petitioner all of whom are under the age of twenty one years the eldest being fourteen and the youngest four months of age . That Petitioner and his wife are in destitute circumstances and are absolutely unable to support and maintain the said children.
          That the property assigned by the said deed is of the value of Six hundred dollars or thereabouts and Petitioner and his wife are desirous that the same shall be realized for the support of the said children

          Petitioner therefore prays that he may be appointed guardian of the Estate of the Said children and that an ad? be made f the sale of the said property f the support

of the said children and that such further order may be made as to justice shall appertain
