IN THE SUPREME COURT.}

AFFIDAVIT.

You shall swear that you believe this to be the true Last Will and Testament of Gregory Griffin late of Saint Johns in the Central District of Newfoundland Farmer deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased; so far as the Goods shall extend and the Law shall bind you ; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased,together with a just and true account into the Registry of the Su-preme Court of Newfoundland, when you shall be lawfully called thereto:   And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Gregory Griffin                    Deceased, and of which  he          -------- died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of three           hundred -------------------- Dollars.

The Petition of the Very Reverend John Ryan of    St Johns Roman Catholic Priest

Humbly sheweth

That Gregory Griffin formerly of St Johns in the said Island farmer died there on or about the twenty fourth day of January ---------- in this present year having first made and executed his last will and testament as hereto annexed and which will has been duly proved in common form. That so far as your Petitioner is aware the said Testator left no relatives him surviving in this Colony except one Walter Lane of St Johns aforesaid fisherman     who, as this dep petitioner is informed, is a nephew of Testator.
That Testator died possessed of property situate within the jurisdiction of this honorable Court of the probable value of about Two hundred and fifty ------------ dollars
That in and by his said last will and testament he nominated and appointed your petitioner as executor thereof. That no probate or administration to the estate of Testator has been heretofore granted petitioner therefore prays that probate of the said will may be granted to him and as in duty bound he will ever pray etc   etc    etc    Dated at St John's this          fifteenth     day of February A.D.1886

I Gregory Griffin of St John's Farmer do make publish and declare this as and for my last will and testament.          I direct that all my just debts funeral and testamentary expenses shall be paid . I give devise and bequeath to the Very Rev-erend John Ryan of St Patricks Riverhead St Johns the sum of Five pounds for Masses For the repose of my soul-    I give devise and bequeath to Mary Flynn my servant all my household furniture, beds, bedding, watch, gun, and other chattels and effects in my dwelling house.    All the rest residue and remainder of my money goods, chattels, property and effects whatsoever I give devise and bequeath to the said Very Reverend John Ryan in trust to distribute the same to and amongst the poor of St Johns in such manner and in such amounts and at such times as he may think proper,  and I do hereby nominate and appoint the said Very Reverend John Ryan Executor of this my will and do revoke all other wills by me heretofore made.     Witness my hand at St Johns this twenty first day of September A.D. 1885

TO WIT       }
Robert J Kent
of Saint Johns , one of Her Majestys Counsel maketh oath and saith that on the Twenty - first day of September A.D. one thousand eight hundred and eighty five at Saint Johns aforesaid          he, this Deponent, was present and did see Gregory Griffin                    late of Saint Johns Farmer          the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for  his     last Will and Testament, in the presence of this Deponent and of Thomas R. O Donnell of Saint Johns aforesaid Student - at . Law the other subscribing witness    thereto. That Deponent and said Thomas R. ODonnell-------------------- then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other- That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of Deponent and the said Thomas R. ODonnell -------------------- and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

After three days from the date hereof application will be Made to the Honorable the Supreme Court or to one of the Honorable the Judges thereof for Probate of the Will of Letters of Administration of the Estate and effects of Gregory Griffin          formerly of St Johns Farmer deceased to be granted to Very Rev John Ryan Executor   as said will named.
