AFFIDAVIT.

You shall swear that you believe this to be the true Last Will and Testament of John Joy formerly of Holyrood in Conception Bay planter now deceased

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you ; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Su- preme Court of Newfoundland, when you shall be lawfully called thereto : And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said John Joy -----------------------------
--------------------------------------------------------- Deceased, and of which he --------------------- died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of three thousand
--------------------------------------------------------------------------------------- Dollars.

The petition of John Veitch of Holyrood Concep-tion Bay Post office woyMa?t?? and? a?tway          station Master and of Philip Mullowney          of same planter

Humbly Sheweth

That John Joy of Holyrood aforesaid Planter died There on or about the twenty sixth day of February last having made and executed his last will and testament in writing as hereto annexed and which has been proved in common form. That the wife of the said Testator died before him. That he left him surviving as next of kin three sons namely James   Walter and John all of whom are still living and reside at Holyrood aforesaid and three daughters namely Mary married to Patrick Duggan of Holyrood aforesaid. Ellen married to John Veitch your petitioner and Bridget married to Edward Murray of Station Main. That all of the said Children are of full age. That said Testator died possessed of property situate within the jurisdiction of this honorable Court of the probable value of about Two thousand four hundred dollars. That in and by his said last will and testament he nominated and appointed your petitioners as executors thereof. That no                                         probate

probate or administration of the estate of the said Testator has been hitherto granted.
     Petitioners therefore pray that probate of the said will may be granted un to them and as in duty bound they will ?? pray

    After three days application will be made to the Honor-able the Supreme Court or to a Judge thereof for probate of the will of    John Joy   late of Holyrood in the Northern  district   planter   deceased to be granted to Philip Mulloney  and  John Veitch both of Holyrood aforesaid Executors named in the said will

On the sixteen of Feb. one thousand eight Hundred and eighty seven. I John Joy of Holyrod Conception Bay in the Island of Newfoundland do make this my last Will And Testament.
Firstly I give and bequeath to my son Walter Joy the water side primes from his present stage and frommy son John's new flake to Barretts and all the land that he holds in his (Walter Joy) pession at present
Second I give & bequeath to my son John Joy the remainder of my land and water side and also my inside farm
I will that ?est part of my land called Targ?tis place to mygrand sons Richard and Walter (sons of John)
I will and bequeath my money in the following manner

I will and bequeath to my dauther Ellen Vietch £25
I will and bequeath to my dauther Bridget Murry £25
I will and bequeath to my son James Joy £25
I will and bequeath to Rev. G. Battcock £5 for to have masses for myself
I will and bequeath to Rev. ?. A Donnell £5 for masses for myself and wife
I give and bequeath £5 for High Mass for ?neself
I will and bequeath to my son John Joy £130 more or less
I will and bequeath to my grand son Walter of John my bed and bed sted
I appoint John Vietch and Phillip Mullowney both of Holyrood to be My Executors Given under my hand and seal the day and year above written

of St.John's aforesaid, Fisherman maketh oath and saith that on the sixteenth day of February A.D. one thousand eight hundred and eighty seven at Holyrood Conception Bay          he, this Deponent, was present and did see John Joy ----------------------------------------- late of Holyrood Planter          the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Cornelius Kennedy

the other subscribing witness    thereto. That Deponent and said   Cornelius Kennedy
then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other - That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to and (initials interlined in left margin,) G .I.a. it was approved of by the said Testator in the presence of Deponent and the said    Cornelius Kennedy and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
