To the Honourable the Supreme Court
of Newfoundland or any one of the
Honourable The Judges thereof

          The Petition of the Reverend Patrick J Delaney of St. Johns Roman Catholic priest and of Henry Cooke of same place Manager of the Commercial Bank of Newfoundland

Humbly Sheweth

          That Terence Halerne of St Johns aforesaid Master Mariner died there on or about the seventeenth day of December last past having made and executed his last will and testament with Codicil thereto as hereunto annexed and which will and codicil have been duly proved in common form. That he left him surviving his Widow Catherine and his niece Annie Halerne each of whom resided with him in S. Johns aforesaid up to the time of his death. That he died possessed of property situate within the Jurisdiction of this honorable Court of the probable value of about Thirty two thousand dollars. That in and by his said last will and testament he nominated and appointed the Roman Catholic Bishop for the time being of S. Johns as executor thereof and in? and by his said Codicil ???? he nominated and appointed your petitioner as executors of his said will and Codicil in addition to and to act in Conjunction with the said Roman Catholic Bishop of S. Johns. That the Most Reverend Thomas Joseph Power the new? Roman Catholic Bishop of S. Johns has duly renounced the said executorship as approved? by the formal renunciation thereof, signed by him, dated the twenty first day of this present month of January and hereto annexed. That no probate of the said will or administration of the estate of the said

deceased has been hitherto granted. Petitioners therefore pray that probate of the said will may be granted unto them and as in duty bound they will ever pray &c &c &c. Dated at S. Johns this 24th day of January A.D. 1888

          Joseph I Little of St. John's aforesaid one of the Assistant Judges of the Supreme Court of ?????????? Newfoundland maketh oath and saith that on the            day of August A.D. one thousand eight hundred and eighty seventy seven at St. Johns aforesaid he, this Deponent, was present and did see Terence Hallern late of St. JohnsMaster Mariner the Testator named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and in his last Will and Testament, in the presence of this Deponent and of Edward Burke the other subscribing witness thereto. That Deponent and said Edward Burke then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding to the best of Deponent's knowledge and belief.

I Terrence Hollerhan of Saint Johns do make ordain and publish the following as and for my last will and Testament Viz:
To my Executor hereinafter named, I will and bequeath all my landed property, goods, chattels Bank Stock monies and effects to take, have and hold the same for the sole use and benefit of my beloved wife Catherine during her lifetime and subject to her disposition by will or deed wherein I direct and desire proper provision shall be made for the support and maintenance of ??? neice Annie now residing with us and which I now impose as a charge on my Estate - and after having made such provision it is my further will and desire that my wife will direct the appropriation after her demise of the residue of my Estate to such religions? and charitable purposes as in her judgment she may consider most deserving of

consideration.
          I hereby nominate and appoint the Roman Catholic Bishop for the time being, of Saint Johns Executor of this my last will hereby revoking and cancelling all other wills made by me.
          Dated at Saint Johns this            day of August 1877?

In addition to and to act in conjunction with The Roman Catholic Bishop of S. Johns for the time being I hereby nominate and appoint the Reverend Patrick Delaney of St. Johns Roman Catholic priest and Henry Cooke of S. Johns Manager of the Commercial bank of Newfoundland as executors of my said will and of this Codicil thereto and I confirm in my said will in all other respects, Dated at S. Johns this 25th day of September AD 188?

          I the Most Reverend Thomas J Power Bishop of Saint Johns make oath and say that I freely and voluntarily renounce all right to act as Executor of the last will and testament with codicil thereto of Terence Hallarn late of St. Johns in the Central District of Newfoundland Master Mariner deceased and that I have not in any intermeddled (sic) with the affairs of the said Estate.

Delaney and Henry Cooke the other subscribing witnesses thereto. That Deponent and said Patrick I. Delaney and Henry Cooke then and there signed their names to such Codicil as such witnesses, in the presence of the said Testator and of each other.
and that at the time of the said execution of the said Codicil the said Testator was of sound and disposing mind, memory and understanding to the best of Deponents knowledge and belief.
