Terence Hallern 1888
To the Honourable the Supreme Court The Petition of the Reverend Patrick J Delaney of St. Johns Roman Catholic priest and of Henry Cooke of same place Manager of the Commercial Bank of Newfoundland Humbly Sheweth That Terence Halerne of St Johns aforesaid Master Mariner died there on or about the seventeenth day of December last past having made and executed his last will and testament with Codicil thereto as hereunto annexed and which will and codicil have been duly proved in common form. That he left him surviving his Widow Catherine and his niece Annie Halerne each of whom resided with him in S. Johns aforesaid up to the time of his death. That he died possessed of property situate within the Jurisdiction of this honorable Court of the probable value of about Thirty two thousand dollars. That in and by his said last will and testament he nominated and appointed the Roman Catholic Bishop for the time being of S. Johns as executor thereof and in? and by his said Codicil ???? he nominated and appointed your petitioner as executors of his said will and Codicil in addition to and to act in Conjunction with the said Roman Catholic Bishop of S. Johns. That the Most Reverend Thomas Joseph Power the new? Roman Catholic Bishop of S. Johns has duly renounced the said executorship as approved? by the formal renunciation thereof, signed by him, dated the twenty first day of this present month of January and hereto annexed. That no probate of the said will or administration of the estate of the said deceased has been hitherto granted. Petitioners therefore pray that probate of the said will may be granted unto them and as in duty bound they will ever pray &c &c &c. Dated at S. Johns this 24th day of January A.D. 1888 Robert J. Supreme Court of Newfoundland Central District Joseph I Little of St. John's aforesaid one of the Assistant Judges of the Supreme Court of ?????????? Newfoundland maketh oath and saith that on the day of August A.D. one thousand eight hundred and Sworn before me at St. Johns in Geo. I. Adams
I Terrence Hollerhan of Saint Johns do make ordain and publish the following as and for my last will and Testament Viz: consideration. Witness I Terence Hallern of St. Johns the Testator in the above written will named do hereby make and publish this as and for a Codicil to the above written will. In addition to and to act in conjunction with The Roman Catholic Bishop of S. Johns for the time being I hereby nominate and appoint the Reverend Patrick Delaney of St. Johns Roman Catholic priest and Henry Cooke of S. Johns Manager of the Commercial bank of Newfoundland as executors of my said will and of this Codicil thereto and I confirm in my said will in all other respects, Dated at S. Johns this 25th day of September AD 188?
In the Supreme Court In the matter of the last I the Most Reverend Thomas J Power Bishop of Saint Johns make oath and say that I freely and voluntarily renounce all right to act as Executor of the last will and testament with codicil thereto of Terence Hallarn late of St. Johns in the Central District of Newfoundland Master Mariner deceased and that I have not in any intermeddled (sic) with the affairs of the said Estate.
