AFFIDAVIT Newfoundland } You shall swear that you believe this to be the true Last Will and Testament of Mary Ann Ryan late of St. John's in the Central District of Newfoundland widow deceased You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Mary Ann Ryan Deceased, and of which she died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of one thousand six hundred dollars. To the Honorable the Supreme Court of any one of the honorable the Judges thereof - The Petition of Samuel Ryan of St. Johns Pilot and of John Dudley of same place Carpenter Humbly Sheweth That Mary Anne Ryan late of St. John's aforesaid Widow died there on or about the twenty third day of March last past having first made and executed her last will and Testament as hereto annexed and which will has been duly proved in Common form. That said deceased left her surviving two sons, namely your petitioner the said Samuel Ryan and John Ryan who is since then deceased. Also one daughter Mary Anne the now wife of your petitioner the said John Dudley. That she died possessed of property situate within the Jurisdiction of this honorable court of the probable value of about sixteen hundred dollars. That in and by her last will and testament she nominated and appointed your petitioners as executors thereof. SUPREME COURT OF NEWFOUNDLAND ST. JOHN'S } Richard I. Callahan of St. John's Baker maketh oath and saith that on the Sixth day of December A.D. one thousand eight hundred and eighty two at Saint John's aforesaid, he, this Deponent, was present and did see Mary Ann Ryan late of St. John's widow the Testatrix named in the paper writing hereunto annexed duly sign (by making her mark) publish and declare the said annexed paper writing as and for her last Will and Testament, in the presence of this Deponent and of Michael I. O'Mara of St. Johns Solicitor, the other subscribing witness thereto. That Deponent and said Michael I. O'Mara then signed their names to such Will as such witnesses, in the presence of the said Testatrix and of each other. That previously to the said Will being so signed as aforesaid, by the said Testatrix and the said witnesses, it was read over and approved of by the said Testatrix in the presence of Deponent and the said Michael I O'Mara and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief. In the Name of God Amen I Mary Anne Ryan of Newfoundland Widow do make publish and declare this paper writing to be my last will and testament and I hereby annul all former wills or testaments by me made or executed. First - I give devise and bequeath unto my daughter Mary Anne Dudley wife of John Dudley Carpenter the dwelling house situate on ??? Road and at present occupied by the widow Meehan? ?? and for her sole and absolute use for ever free from the debts and control of her present or any future husband she may have. Second I give devise and bequeath unto my three sons John, Thomas, and Samuel Ryan the House in Cochrane Street in which I now reside together with all other property of every description I may die possessed of, share and share alike. I hereby nominate and appoint my son Samuel and my Son in Law John Dudley Executors of this my last will and testament. In Witness whereof I have hereunto subscribed my name at St. John's aforesaid this 6th day of December 1882
