AFFIDAVIT

You shall swear that you believe this to be the true Last Will and Testament of Francis Scott, late of Saint Johns in the Central District of Newfoundland, formerly of Her Majesty's Service, deceased - You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you: and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Deceased, and of which he died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of One thousand five hundred dollars

So help you God

Edward Thomas of St. Johns aforesaid Carpenter maketh oath and saith that on the first day of March A.D. one thousand eight hundred and eighty eight at St Johns he, this Deponent, was present and did see Francis Scott late of St. Johns the Testator named in the paper writing hereunto annexed duly sign publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of John Haddon the other subscribing witness thereto. That Deponent and said John Haddon then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

The Last Will and Testament of me Francis Scott of St. Johns, Nfld. formerly of Her Majestys Service, now a Pensioner.
First, I Will and Bequeath to my beloved wife Elizabeth Scott all the right title and interest to my Estate in and to a certain Policy of Insurance effected upon my life for the Sum of One Hundred Pounds Sterling -
Second - Should my wife die before me then the Policy of Insurance of One Hundred pounds is to be divided between the children of Francis Scott, Elizabeth Vey (deceased) and Georgina Downey (also deceased) as follows -
To the children of Francis Scott that is Henry Scott, Walter Scott, William Scott and Edith Scott one third of the said one hundred pounds between them, Share and Share alike - To the children of my daughter the late Elizabeth Vey that is Gertrude Vey, Mary Bell Vey, Julia Vey and Margaret Vey - one third of the one Hundred Pounds between them Share and Share alike - and to the child of my second daughter the late Georgina Downey - that is Alice Downey the remaining one-third of the one hundred pounds Insurance as is above mentioned.
Third - I give and bequeath to my wife during the time of her natural life all my right title and interest in and to the dwelling house I now possess situate on Hayward Avenue and after her death then the house is to be held by my Executors hereafter named and to be disposed of as follows - after paying for insurance and incidental expenses the remainder of rents to be paid to my grand

 

daughters Alice Downey until she is married or in case of her death before marriage then the house is to be sold and the proceeds divided between my grand children as in the Second part of this Will Share and Share alike - Should Alice Downey live after the house is sold then she is to have one third of the net proceeds of the house - and the other grand children named to have the other two thirds divided between them share and share alike - should however my wife Elizabeth Scott survive and require means for her actual support and maintenance she may raise a sufficient sum for her requirements by way of mortgage or other wise as she may be advised by my executors -
Fourth - I leave and bequeath all my household furniture and personal effects to my wife and after her death to my grand daughter Alice Downey daughter of my late daughter Georgina Downey -
Fifth - after the payment of all my past debts and funeral and testamentary expenses of myself and my wife I will and bequeath to my grand daughter Elizabeth Vey all the rest, residue, and remainder of the Estate of which I may or shall die possessed.
Sixth - I hereby revoke, cancel, and annul all former wills and codicils to wills that I have made and I now constitute and appoint Lionel T. Chancey of St. Johns Sub-Sheriff and James Augustus Clift also of St. Johns

 

solicitor and attorney at law to be my executor of this my last will and testament -
In witness whereof I have hereunto subscribed my hand at St. Johns aforesaid this first day of March - Anno Domini one thousand eight hundred and eighty eight -

Notice

Three days after the date hereof application will be made to one of the Honourable the Judges of the Supreme Court for Probate to the Will of Francis Scott late of St. Johns pensioner deceased to be granted to the under-signed executors named in said will.
          Dated at St. John's this 7th day of April 1888

The petition of Lionel T. Chancey of St. Johns in the Island of Newfoundland Sub-Sheriff - and James Augustus Clift of same place Barrister at Law

Humbly Sheweth

That Francis Scott late of St. Johns in the island of Newfoundland formerly of her Majesty's Service - deceased - died at St. John's aforesaid on or about the third day of April last past
That said deceased left him surviving his widow and his son Francis Scott
That said deceased was at the time of his deceased possessed of property money and effects of the probable value of fifteen hundred dollars
That said deceased left a will which is hereto annexed and which has been proven in due form of law by the affidavit of Edward Thomas one of the subscribing witnesses thereto
That under said will

 

petitioners were appointed executors
          Your petitioners therefore pray that Probate to the said will may be granted to them.
          And as in duty bound will ever pray
          Dated at St. Johns this 14th day of April A.D. 1888
