SUPREME COURT OF NEWFOUNDLAND

ST. JOHN'S
TO WIT
Thomas J.Murphy of St. John's aforesaid, Solicitor, maketh oath and saith that on the nineteenth day of February A.D. one thousand eight hundred and eighty eight at St. John's aforesaid he, this deponent was present and did see Patrick Kenny, late of the same place, the Testator named in the paper writing hereto annexed, duly sign, (by making his his mark) publish and declare the said annexed paper writing as and for his last Will and Testament in the presence of this Deponent and of Maurice A. Devine and John Lawlor, the other subscribing witnesses thereto. That Deponent and said Maurice A. Devine and John Lawlor then signed their names to such Will as such witnesses in the presence of the said Testator and of each other That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by, the said Testator in the presence of Deponent and the said Maurice A. Devine and John Lawlor and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

Notice

After three days application will be made to the Honorable the Supreme Court or one of the Honorable the Judges thereof for Probate to the Will of Patrick Kenny late of Portugal Cove Road, Farmer, to be granted to Mary Kenny, wife of deceased and Executrix to the Will.

I hereby certify that the notice on the other side hereof was posted in this office from the day of the date thereof until this day and that no caveat or other objection has been entered thereto.

This is the Last Will and Testament of Mr. Patk Kenny of the Portugal Cove Road, farmer. I will and bequeath all my right title and interest in the farm upon which I am now living to my beloved wife Mary together with all my interest in the farm stock, cattle, horses, utensils and barns, buildings, dwelling house and furniture to have and to hold for the natural term of her life and after her death the said property to go to such one or ones of my children as she may will it to by her Last Testament and I further will that all other property of which I am now possessed or shall hereafter be possessed to go to her for life and to such of my children after her death as she may will it to by her last testament. I forbid

her from encumbering, mortgaging or in any way disposing of any portion of the landed property of which I am now possessed until all my children shall have arrived at the age of twenty one years. I appoint my wife Executrix.

The Petition of Mary Kenny of Saint John's, wife and Executrix of the late Patrick Kenny of the same place, farmer.

Humbly Sheweth

That Patrick Kenny, husband of petitioner and a farmer died at Saint John's aforesaid in the month of February Anno Domini one thousand eight hundred and eighty eight having first made and published his last will and testament.
That Petitioner is the Executrix named in the said will which is hereto annexed.
That the property disposed of in said will consists of farm land, dwelling house, furniture, stables, stock and agricultural implements.
That the value of said property amounts to a total of about three thousand dollars.
That the said will has not

been admitted to Probate nor has any administration been granted or prayed for.
Your Petitioner therefore prays that Probate of the said will may be granted unto her and as in duty bound &c
Dated at Saint John's aforesaid this fifteenth day of January A.D. 1889.

AFFIDAVIT.

You shall swear that you believe this to be the true last Will and Testament of Patrick Kenny late of St. John's in the Central District of Newfoundland, Farmer, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said Patick Kenny, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of three thousand five hundred Dollars.

So help you God.
