To the Honourable the Supreme Court or one of the Honourable the Judges thereof

The Petition of William Flight of Pouch Cove Fisherman
           Humbly sheweth
1st That Richard Newell late of Pouch Cove died on the twenty eighth day of August eighteen hundred and ninety one
2nd That the said Richard Newell made a will some time before his death in which he appointed your petitioner sole executor
3rd That the value of deceased's estate does not exceed four hundred dollars
4th That no probate or administration has been prayed for or granted to said estate
Your petitioner therefore prays that probate to the said will be granted to him.
    And as in duty bound he doth ever pray

The petition of Elijah Newell of saint John's Shoemaker
             Respectfully sheweth as follows:-
1. Richard Newell late of Pouch Cove Fisherman father of Petitioner died there on or about the 28th day of August last at Pouch Cove and at the time of his death was possessed of property of the value of which petitioner is not aware.
2. I am informed that the said deceased left a will and that said will is in the possession of William Flight of Pouch Cove Fisherman.
Petitioner therefore prays:-
1. That said William Flight may be ordered to produce and file the said will in this court.
2. That the said will may be proved in thence form
3. That failing such proof administration of the estate of deceased may be parted to such person as the court may appoint
4. That such further order may be made as shall be necessary.
Dated at St. John's the 17th day of September AD 1890

Let all parties concerned attend before Mr. Justice Pinsent in chambers at the Court House on Tuesday the 6th day of October Next at 11 o'clock a.m. on the hearing of an application on behalf of the Plaintiff for an order on the defendant to produce and bring into Court the will of Richard Newell late of Pouch Cove Fisherman deceased and (2) upon production of said will that the same may be proved in solemn form and (3) that failing such proof administration of the estate of said deceased may be granted to such person as the Court may appoint

IN THE SUPREME COURT,

AFFIDAVIT.

You shall swear that you believe this to be the true last Will and Testament of Richard Newell late of Pouch Cove in the Central District, Planter, deceased
You shall swear that you will pay all the debts and legacies of the deceased, so far as the Goods shall extend and the law shall bind you; and that you will exhibit a true, full, and perfect inventory of all and every the Goods, Rights and Credits of the deceased, together with a just, and true account, into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto; And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Richard Newell deceased, and of which he died possessed, do not according to the best of your knowledge, judgment and belief, amount to the value of four hundred Dollars,

So help you God.

To wit.
Solomon Matthews clerk in holy orders of Pouch Cove maketh oath and saith that on the twenty seventh day of September A.D. one thousand eight hundred and eighty ninety at Pouch Cove Newfoundland he, this Deponent, was present and did see Richard Newell late of Pouch Cove the Testator named in the paper writing hereunto annexed duly sign, (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of his Deponent and of Charles Pippy the other subscribing witness thereto. That Deponent and said Charles Pippy then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by, the said Testator in the presence of Deponent and the said Charles Pippy and that at the time of the execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

This is the last will and testament of Richard Newell of Pouch Cove Newfoundland I hereby give devise and bequeath to William Flight of Pouch Cove his heirs, executors and administrators for his and their own use and benefit absolutely and forever all my estate and effects both real and personal whatsoever and wheresoever and of what nature and quality soever and I hereby appoint the said William Flight sole executor of this my will In witness whereof I have hereunto set my hand this twenty seventh day of September one thousand eight hundred and ninety
