You shall swear that you believe this to be the true last Will and Testament of Michael St John late of Conception Harbor in the Northern District Planter deceased ---------------------------------------------------------------------------------------------------------------------------------
You shall swear that you will pay all the Debts and Legacies of the deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account, into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto; And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects (of the said) Michael St John deceased, and of which he died possessed, do not (according to the best) of your knowledge, judgment and belief, amount to the value of fourteen (hundred*) Dollars.
So help you God.

The Petition of Edward S John of Conception Harbor Planter deceased and James S John:
Humbly Sheweth
That Michael S John of Conception Harbor Planter deceased died at that place on or about the first day of January AD 1892
That previous to his death the said deceased made and subscribed his last Will and Testament which is hereunto annexed proven upon the oath of Bernard St John one of the subscribing witnesses thereto
That Said deceased left him surviving five children four sons and one daughter all over age
That in and by said last will and testament said deceased appointed your Petitioner and Said James S John to be Executors thereof
That at the time of his death the Said deceased was possessed

of property within the jurisdiction of this Honorable Court of the probable value of Thirteen hundred and fifty dollars
That neither probate to any last will or Letters of Administration to Estate of said deceased has yet been granted to any person
Your Petitioner therefor prays that your Honorable Court may grant to him and the said James S John Letters of Probate to the Said last Will and testament as Executors thereof and as in duty bound they will Ever pray

I Michael St John declare this to be my last Will and Testament and do dispose of all my worldly effects in the following manner and form
First - I give and bequeath to my eldest son John St John of Broad Cove his dwelling and
outhouses land under cultivation and forest land now in his possession.
Secondly - I give and bequeath to my second eldest son, Edward St John his own dwelling and
land attached; my own stable and half cellar my horse, harness, cart, wheels, dray, catamaran and sleigh together with the one third part of my outside lands, situated around my dwelling and stable but after the death of my lawful wife Catherine St Johnbut after the death of my lawful wife Catherine St John the Said Edward is to have and to hold allhalf the outside lands where my dwelling and stable are situated and a proportional part of the inside land, known as Big Pond farm; in order to make up an equal share of half my lands, between himself and Edward St John his son Michael
Thirdly - I give and bequeath to my third son, Thomas St John, his dwelling and outhouses
situated at the Big Pond with the one-third of my land but after the death of my wife, Catherine St John, he is to have and to hold half of my land, which half is to be made up out of the Big Pond farm, and he is to have no claim, whatsoever, on the lands situated around My dwelling and stable.

Fourthly - I give and bequeath to my youngest son Michael St John, now residing in the United
States the sum of fifty cents - 50ȼ
Fifthly - I give and bequeath to my grandson, Michael St John, Son of Edward, my dwelling
House and furniture after the death of my wife, Catherine St. John and one half of the land which surrounds my dwelling and stable.
Sixthly - I give and bequeath to my wife, Catherine St John, my dwelling, half my cellar and
two-thirds of my lands until after her death or such time as she may leave or marry again
Seventhly - I give and bequeath to my three sons John, Edward and Thomas and to my
daughter Elizabeth McGee, an equal share of all my money remaining after my death.
Eighthly - I give and bequeath the Sum of twenty four dollars ($24.00) for a tomb-stone for my-self to be paid by my executor, twenty dollars for a High Mass, and Eighty for funeral Expenses.
Ninthly - I do appoint my two sons John and Edward to be executors of this my last Will and
Testament.

Bernard St John of Conception Harbor District of Harbor Main, in the Northern District of the Island of Newfoundland Fisherman maketh oath and saith that on the fourteenth day of December A.D. one thousand eight hundred and ninety one at Conception Harbor aforesaid he the deponent was present and did see Michael St John late of Conception Harbor aforesaid Planter and Farmer the Testator named in the paper writing hereto annexed duly sign publish and declare the said annexed paper writing as and for his last Will and Testament in the presence of this Deponent and of James St John then and there signed their names to such Will as such witnesses in the presence of the said Testator and of each other and that at the time of the said Execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

I Bernard St John -------------- of Conception Harbor in the Northern District of Newfoundland Fisherman make oath and say that on the 14th ------------- day of December A.D. One Thousand Eight Hundred and ninety-one ------------ at Conception Harbor aforesaid I was present and did see Michael St John late of Conception Harbor, Planter and Farmer the Testator named in the paper writing hereunto annexed, duly sign, (by making his mark) pub-lish and declare the said annexed paper writing, marked A as and for his last Will and Testament in my presence, and in the presence of me and of James St John of Conception Harbor the other subscribingwitness thereto. That I and said James St John then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by, the said Testator in the presence of me and the said James St John ------------------- and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.
