NEWFOUNDLAND
Valley????  To Wit          I do swear that I believe that James Patten late of Middle Bight in the Central District of Newfoundland, of no occupation deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of two hundred and fifty dollars.

So help me God

I James Pittman of Middle Bight, South Shore, Conception Bay in the Island of Newfoundland, of no occupation, being very sick and weak in body, but of perfect mind and memory, do make and ordain this my last Will and Testament.
I give and bequeath to my sister, Emma Bishop wife of John Bishop of Middle Bight, will the cultivated and uncultivated land that I possess, willed and bequeathed to me by my father the late John Petten ??? ??? p??? of land in Middle Bight North of Main Road and one piece in the country south of the Main Road also in Middle Bight, to have and to hold the said pieces of land for her own sole use and benefit forever, and I do hereby utterly disallow and disannul all and every other former testaments, Wills, and Bequests by me at any time before named, willed and bequeathed, ratifying and confirming this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal this 11th day of September in the year of our Lord One Thousand Eight Hundred and Ninety Four.

St. John's   To Wit          I Francis F. Furneaux of Kelligrews, Conception Bay/ at present of St. Johns aforesaid / School Teacher make oath and say that on the Eleventh day of September A.D. one thousand eight hundred and ninety four at Middle Bight, Conception Bay, I was present and did see James Petten late of Middle Bight aforesaid, of no occupation, the Testator named in the paper writing hereunto annexed, Marked A, duly sign, (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and of Alfred Butler, the other subscribing witness thereto. That I and said Alfred Butler then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed, as aforesaid, by the said Testator and the said witness, it was read over to, and approved of by the said Testator in the presence of me and the said Alfred Butler and that at the time of the said execution of the said Will, the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

          The Petition of Emma Bishop, wife of John Bishop of Middle Bight, Fisherman

Humbly Sheweth

          That your Petitioner's brother James Petten of Middle Bight aforesaid (of no occupation) died at that place on or about the 22nd day of September A.D. 1894 leaving him surviving as next of kin a brother and three sisters.
          That at the time of his death the said deceased was possessed of lands and effects of the probable value of Two Hundred dollars.
          That said deceased left a will which has been proven in due form of law by the affidavit of Francis F. Furneaux one of the subscribing witnesses thereto and which said will and affidavit are hereto annexed.
          That under said will your Petitioner is sole legatee.

 

          That neither Probate nor Letters of administration have as yet been granted to said Estate.
          Your Petitioner therefore prays that Letters of administration (with will annexed) may be granted to him
          And as in duty bound she will ever pray
          Dated at Middle Bight this 3rd day of September A.D. 1895

Be it Remembered That on this Sixteenth day of October in the           Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and ninety five personally appeared Emma Bishop of Middle Bight on the South Shore of Conception Bay, William Butler farmer and Alfred Andrews fisherman both of Middle Bight, Conception Bay and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Four Hundred Dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Emma Bishop as Administratrix of the Estate and Effects of James Petten late of Middle Bight of no occupation deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Emma Bishop as such Administratrix or to the hands or possession of any other person, or persons, for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the Sixteenth day of April next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of her the said Emma Bishop or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the Sixteenth day of October which will be in the Year of Our Lord One Thousand Eight Hundred and ninety six and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
