In the Estate of Thomas Conway deceased, I Alexander Ryan of Birchy cove, Bay of Islands, in the Electoral District of S. Georges, General Dealer, make oath and say:
That I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament of Thomas Conway late of Birchy Cove in the Electoral District of St. Georges, deceased: That I am the Executor therein named and that I will well and faithfully administer the estate and effects of the testator by paying his just debts and the legacies contained in his Will, so far as the same shall thereto extend and the law bind me, and by distributing the residue (if any) of the estate according to law; and that I will exhibit under oath a true, full and perfect inventory of all and singular the estate and effects, rights and credits, of the testator and render a just and true account thereof whenever required by law so to do: that the testator died at Birchy Cove, aforesaid on the 17th day of July, one thousand eight hundred and eighty six and that the gross value of the estate and effects, rights, and credits, of the said testator is Four hundred and fifty dollars, and no more, according to the best of my knowledge, information and belief

I Thomas Conway of Birchy Cove Bay of Islands Newfoundland Planter being sick in body but sound in mind do make this as my last will and testament as follows:

  1. Firstly - I hereby give devise and bequeath to my youngest daughter Teresa Conway, her heirs executors and administrators for her and their use and benefit for ever, the square of land with all houses or erections thereon and herein described containing about one and a half acres more or less extending along the North East River Side Public Road about one hundred and thirty feet, and extending along the Back Road South West Side also One hundred and thirty feet being a small portion of Lot No. 1 marked on the diagram of my Grant from Government for said land.
  2. Secondly I hereby give devise and bequeath to my eldest daughter Catherine Badcock her heirs Executors and Administrators for her and their use absolutely and for ever, all the remaining of my land cleared and uncleared held under grant by me from Government entitled No. 1 and No. 2 Lots on diagram of the said grant from Nfld Government and containing about twelve and a half acres, more or less on all or with all Erections emblements [sic] and messuages [sic] at present thereon and

    herein mentioned and described : One large store one small store or shed on the water side and one large new house nearly finished, and one barn for hay on lot No one Also one ox and what sheep I possess with all my fishing gear consisting of herring nets anchors rope & ----- and one fishing boat infact [sic] all my real estate of every kind whatsoever that I am possessed of ----- I give devise and bequeath to the aforesaid Catherine Badcock her heirs executors and assigns absolutely and forever.

I appoint Alex W. Ryan of Bay of Islands executor of this my last will and testament.
In witness whereof I have hereunto set my hand and seal this nineth [sic] day of July Anno Domini Eighteen Hundred and Ninety Six.

Three days from the date hereof application will be made to the Honorable the Supreme Court or to one of the Honorable the Judges thereof for a grant of Probate of the will of Thomas Conway late of Bay of Islands deceased to Alexander W. Ryan the Executor therein named.

To the Honorable the Supreme Court or one of the Honorable the Judges thereof.

The Petition of Alexander W. Ryan of Birchy Cove, Bay of Islands, General Dealer

Humbly sheweth

  1. That Thomas Conway of Birchy Cove aforesaid deceased died at that place on or about the 17th day of July Anno Domini 1896 leaving a will which is hereunto annexed and marked A.
  2. That the said Thomas Conway was at the time of his death possessed of certain property within the jurisdiction of this Honorable Court of the probable value of four hundred dollars
  3. That in and by the said will your petitioner was appointed executor of the estate of the said Thomas Conway.
  4. That no Probate or administration to the estate of the said Thomas Conway has ever been granted by your Honorable Court to any person nor has any person ever applied for same.

          Your Petitioner therefore prays that your Honorable Court or Your Lordship shall be pleased to grant unto him Letters of Probate to the said Estate of the said Thomas Conway deceased.
          And as in duty bound he will ever pray.
          Dated at Birchy Cove the 22nd day of October AD 1900.

  2. That the several matters and things therein contained are just correct and true to the best of my knowledge judgment and belief.

          Sworn before me at Bay of Islands aforesaid this 22nd day of October AD 1900.

Bay of Islands to wit          I George Webber of Bay of Islands aforesaid Physician make oath and say as follows :-
That I am one of the subscribing witnesses to the will of the late Thomas Conway of Bay of Islands deceased which said will is hereunto annexed and marked A.
That on the 9th day of July AD 1896 this deponent and Mr. William Petrie were present and saw the said Thomas Conway sign the said hereto annexed will by making his mark thereto; that before the said will was so signed by the said Thomas Conway it was read over and explained to him in the presence of this deponent and the said William Petrie; that the said Mr. William Petrie and this deponent subscribed their names to the said will as witnesses in the presence of the said Thomas Conway and in the presence of each other.
