In the Estate of Richard B. Holden deceased, I Richard K. Holden of St. Johns  in the Electoral District of St. Johns, in the Island of Newfoundland, Accountant, make oath and say that I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament of Richard B. Holden, late of St. Johns in the Electoral District of St. Johns, Gentleman, deceased, and that I will well and faithfully administer the estate and effects of the said deceased by paying his just debts and the legacies contained in the said Will, and by distributing the residue (if any) of the estate according to law: and that I will exhibit a true, full and perfect inventory of all and singular the estate and effects, rights and credits, and render a just and true account thereof whenever required by law so to do: that the said deceased, at the time of his death, had a fixed place of abode in the Island aforesaid; and that the gross value of the said estate and effects, rights, and credits of the deceased is Four hundred and fifty dollars, and no more, according to the best of my knowledge, information and belief.

In the Estate of Richard Holden deceased, we Joseph Roper of St. Johns in the Electoral District of St. Johns, Watch Maker, and Jasper Cook of St. Johns, Victualler, severally make oath and say: That we are the proposed sureties on behalf of the intended administrator, with the Will annexed, of the estate and effects, rights and credits of the said deceased, and I the said Joseph Roper for myself make oath and say: that I am worth property to the amount of Four hundred and fifty dollars, over and above all incumbrances and over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser or otherwise, and I the said Jasper Cook for myself make oath and say, that I am worth property to the amount of Four hundred and fifty dollars over and above what will pay my just debts and every other sum for which I am now bail or for which I am liable as surety or endorser or otherwise.

Know all Men by these Presents: That we Richard K. Holden of St. Johns in the Electoral District of St. Johns East, of St. Johns, Accountant, Joseph Roper of St. Johns, Watchmaker, and Tasker Cook of St. Johns, Victualler are jointly and severally bound unto our Sovereign Lady Victoria by the Grace of God, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, in the sum of Nine hundred dollars, to be paid to our said Sovereign Lady the Queen, Her Heirs and Successors for which payment well and truly to be made, we bind ourselves and each of us for the whole, our and each of our executors and administrators, firmly by these presents. Sealed with our seals.

Dated the          day of          in the year of our Lord 1900.

The Condition of this obligationis such that if the above named Richard K. Holden as administrator of all the estate and effects, rights and credits of Richard B. Holden late of St. Johns in the Electoral District of St. Johns in the Island of Newfoundland, Gentleman, deceased, (who died on or about the 15th day of April A.D. 1897? do, when lawfully called on in that behalf, make, or cause to be made, a true and perfect inventory of all and singular the estate and effects, rights and credits of the said deceased, which have or shall come into the hands, possession or knowledge of him the said Richard B. Holden or into the hands or possession of any other person or persons for him and the same so made do exhibit, or cause to be exhibited, into the Registry of the Supreme Court of Newfoundland, whenever required by law so to do, and the same estate and effects, rights and credits, and all other estate and effects, rights and credits of the said deceased at the time of his death, which at any time after shall come into the hands or possession of the said Richard K. Holden or into the hands or possession of any other person or persons for him, do well and truly administer according to law, that is to say, do pay the debts which the said deceased did owe at his decease; and then the Legacies contained in the Will annexed to the said Letters of Administration to the said Richard K. Holden committed, as far as such property will thereunder extend, and the law bind him, and further, do make, or cause to be made, a full true and just account of his said administration within twelve months or sooner if thereunto required, and all the rest and residue of the property shall deliver and pay unto such person or persons as shall be by law entitled thereto; then this obligation to be void and of no effect, or else to remain in full force and virtue.

After three days application will be made to the Honourable the Supreme Court or one of the Honourable the Judges thereof that letters of administration de bonis non c.t.a. to the estate of Richard B. Holden late of St. Johns, Gentleman, deceased, be granted to Richard K. Holden of St. Johns, deceased.

The petition of Richard K. Holden of St. Johns, Newfoundland, Accountant.

Humbly Sheweth

  1. Mary Holden, widow of Richard B. Holden, late of St. Johns, Gentleman, deceased, was on the 14th day of April A.D. 1898, appointed Administratrix cum testamento annexo of the estate of the said Richard Holden.
  2. The said Mary Holden died on the 15th day of  March last, not having fully administered the said estate.
  3. The balance of the estate not administered consists of the said Richard B. Holden's interest in Pynn's? Estate, the probable value of which is $300.00, and land and house at Harbour Grace worth about $100.00.
  4. The said land and house was not disposed of by the will of the said Richard B. Holden.
  5. The next of kin of said Richard B. Holden at his death were his sister Annie Eliza Canning of Peterborough, Ontario, Canada (and still residing there) and 3 children of a deceased brother viz your petitioner, Sarah Isabell Holden and wife of John Robinson, since deceased.
  6. The Honourable Geo. Skelton is duly appointed executor of the will of the said Mary Holden and his consent to administration ??? as is herein prayed for, is hereto annexed, marked "A".
  7. No letters of administration cum testamento annexo de bonis non of the said estate have yet been granted, and your partitioner [sic] prays that the same may be granted to him; and as in duty bound will ever pray.

I George Skelton of St. Johns, physician, executor of the will of the late Mary Holden, and to whom letters of probate were issued by the Supreme Court on the 30th day of March A.D. 1900, hereby assent to the granting of letters of administration c.t.a. debonis non of the estate of the late R. B. Holden, gentleman, deceased, to Richard K. Holden, one of the next of kin.
