ST. JOHN'S
To Wit          } I do swear that I believe that William Gallishaw, late of Saint John's in the Central District of the Island of Newfoundland, Master Pilot, deceased died with a Will; and that I will well and truly administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full, and perfect Inventory of the Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when he? shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of One Thousand dollars.

IN THE NAME OF GOD, amen.
I, William Gallishaw of Saint John's in the Island of Newfoundland, Pilot, do make, publish and declare this paper writing to be my last Will and Testament and I hereby annul all former Wills by me made or executed.
First, I give, devise and bequeath unto my beloved wife Ellen Gallishaw all of my right, title and interest and unexpired term of, in and to the House and ground now occupied by me, situate on the west side of Cochrane Street as and for her sole use and benefit.
Second, I give, devise and bequeath unto my Sister, Susannah Gallishaw, for her sole use and benefit the house she now lives in, for the unexpired term I have therein, she paying the ground rent thereof.
Third, I give, devise and bequeath unto my adopted daughter Margaret Ryan one watch.
Fourth, I give, devise and bequeath unto my Stepbrother, John Gallishaw, one watch.
Fifth, I give, devise and bequeath unto my Stepbrother, Francis Gallishaw, one watch.
Sixth, I give, devise and bequeath unto my said wife, Ellen Gallishaw, my best watch and chain.
Seventh, I give, devise and bequeath unto my said wife, Ellen Gallishaw, the house adjoining the one occupied by said Sister, Susannah, for my unexpired term therein for her sole use and benefit.
Eighth, I give, devise and bequeath unto my said wife, Ellen Gallishaw, my two Pilot boats and all gear to them belonging.
Ninth, I give, devise and bequeath unto my said wife, Ellen Gallishaw, all other property of every description whatsoever I may die possessed of or be entitled to and not hereinbefore bequeathed to and for her sole use and benefit.
And lastly, I hereby nominate and appoint my said wife, Ellen Gallishaw, Sole Executor of this my last Will and Testament.
IN WITNESS whereof I have hereunto my hand and seal subscribed and set at Saint John's aforesaid this twenty sixth seventh day of May Anno Domini One thousand eight hundred and eighty four.

To wit
Michael J. O'Mara of Saint John's in the Central District maketh oath and saith that on the 27th day of May A.D. one thousand eight hundred and eighty four at St. John's he, this Deponent, was present and did see William Gallishaw, late of St. John's aforesaid, the Testator named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of Richard Carroll of St. John's aforesaid, the other subscribing witness thereto. That Deponent and said Richard Carroll then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

To the Honorable the Supreme Court of
Newfoundland or any one of the
Honorable the Judges thereof

The Petition of Thomas Ryan of St. John's, Mariner

Humbly Sheweth

That William Gallishaw of St. John's, Master Pilot, died there in or about the month of May Anno Domini 1885 (five) having first made and executed his last will and testament as hereto annexed and which will has been duly proved in common form.
That he died possessed of property situate within the jurisdiction of this Honorable Court of the probable value of about One Thousand ????????? dollars.
The he left him surviving Ellen his wife who died at St. John's aforesaid on the twenty eighth ninth day of October last past.
That the next of kin of the said William Gallishaw, deceased, are Philip Gallishaw, his brother and Susannah Gallishaw, his sister married to George Ashman.

 

That in and by his said last will and testament he nominated and appointed the said Ellen Gallishaw, his wife as Sole Executrix thereof but she never took probate of the said will.
That in and by his said last will and testament he bequeathed and left to his said wife all of his property for her own absolute use and benefit save and except one house bequeathed to his sister Susannah, a watch to his adopted daughter Margaret Ryan, daughter of your Petitioner, and a watch each to his stepbrother John Gallishaw and Francis Gallishaw, all of which will on reference to the said annexed will appear.
That no probateof the will or administration of the Estate of the said William Gallishaw, deceased, has been hitherto granted.
That your petitioner, the only brother of the said Ellen Gallishaw, to whom as aforesaid the property of the said William Gallishaw was, with the exceptions above mentioned, bequeathed by him and who was in and by his said will appointed sole executor thereof, and your petitioner has the consent of all the next of kin of the said Ellen Gallishaw deceased to the grant to him of administration of her estate.
That by reason of the death of the said Ellen Gallishaw it is necessary that some one should be appointed as administrator with the will annexed of the Estate of the said William Gallishaw and petitioner therefore prays that such administration may be granted unto him and as in duty bound he will ever pray &c &c &c.
Dated at St. John's this sixth day of November Anno Domini 1886.

Be it Remembered, That on this Eighth day of November in the forty 50th Year of the Reign of our Sovereign Lady VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of Our Lord One Thousand Eight Hundred and Eighty-six personally appeared Thomas Ryan of Saint John's in the Central District of Newfoundland, Mariner, Philip Gallishaw of same place, Shopkeeper and Thomas Grant of same place, Shoemaker, and did acknowledge themselves to be held and firmly bound to our said Lady the Queen, her Heirs and Successors, in the penal Sum of Two Thousand Dollars, to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following:--

NOW THE CONDITION OF THIS OBLIGATION IS SUCH, That if the above bounden Thomas Ryan as Administrator C.T.A. of the Estate and Effects of William Gallishaw late of Saint John's aforesaid, Master Pilot, deceased, do make, or cause to be made, a just, true, and perfect Inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Thomas Ryan as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 8th day of May next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Thomas Ryan or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 8th day of November which will be in the Year of Our Lord One Thousand Eight Hundred and Eighty-seven and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
