Last Will and Testament of
John Torr Gillard of St. John's
Broker deceased.
This is the last will and testament of me John
T. Gillard of St. John's Broker. First. I revoke all other wills
by me at any time heretofore made. Second. I will devise and bequeath
to my wife Elizabeth all my freehold land together with the dwelling house
and stable thereon situate on Barnes Road in St. John's. Third. I
will and bequeath to my said wife Elizabeth the sum of Two Thousand dollars. Fourth
I will and bequeath to my said wife Elizabeth all my household furniture plate
pictures and books. Fifth. I will devise and bequeath all the rest
residue and remainder of my estate both real and personal to my executors to
hold the same upon trust to pay the income arising therefrom unto my said wife, Elizabeth during her lifetime. Sixth. After the death of my said
wife Elizabeth my said executors shall hold the said rest residue and remainder
of my estate upon trust in the first place to pay thereout the sum of Ten thousand
dollars in such manner as my said wife shall by her will direct (or in the
event of my said wife making no testamentary disposition of the same then to
pay the said sum of Ten thousand dollars unto my nephews Sydney Knowles and Cecil
J. Luscombe or their heirs in equal proportions) in the second place
to pay the sum of Two thousand five hundred dollars to the Church of England
Asylum for widows and orphans in St. John's, the sum of Two thousand five hundred
dollars unto the Methodist Orphanage in St. John's, the sum of Two thousand
five hundred dollars unto the Belvidere Roman Catholic Orphanage in St. John's
and the sum of Two thousand five hundred dollars to the Convalescent Home in
St. John's, and in the third place to pay the balance remaining out of the
said rest residue and remainder of my said estate unto my nephews Sydney
Knowles at present of Highwick, Coventry Road Yardley, Birmingham and Cecil
J. Luscombe at present of Burton on Trent or their heirs in equal proportions.
Seventh:
I appoint John Bray Ayre of the firm of Ayre and Sons of St.
John's Merchants and my said wife Elizabeth executors of this my last will
and testament and I bequeath to the said John B. Ayre the
sum of five hundred dollars as a slight acknowledgment of his trouble in acting
as executor of this my will as aforesaid. (Sgd) Jno. T. Gillard.
Signed published and declared by the said John
T. Gillard as and for his last will and Testament in the presence
of us who in his presence and at his request and in the presence of each other
have hereunto subscribed our names as witnesses at St. John's this 29th day
of March A.D. one thousand eight hundred and ninety nine. (Sgd) Herbert
Knight (sgd) C. H. Renouf.
I certify the foregoing to be a correct
copy of the last will and Testament of John T. Gillard deceased
