Last Will and Testament of
Elizabeth Jane Buchan Gillmor
of Edgbaston Birmingham England
Widow deceased.

      This is the last will and Testament of me Elizabeth Jane Buchan Gillmor the wife of William Gillmor of Edgbaston in the City of Birmingham late a Lieutenant Colonel in Her Majestys Army

  • I bequeath to my daughter Edith Livingstone the wife of Edward Steer Hodson the portraits of my brother Sir Frederick Carter K. C. M. G. of my husbands father, the two portraits of Kate Gillmor my picture of Lord Salisbury my picture of Lichfield Cathedral and my picture called "Missed" my two silver coasters one silver salver two large china vases my topaz set of jewelry and all the furniture and appointments in or belonging to my spare bedroom.
  • To my daughter Catherine Isabel the wife of Thomas Wilfred Haughton my pictures of the prince of wales of Nelson and of Wellington of Andromache and my two pictures of Samuel one silver salver my gold watch chain my two gold bracelets my amethyst set of jewelry and all the furniture and appointments in or belonging to my own bed room
  • To my son Fitzwilliam John Carter Gillmor my pictures of Joan of Arc and of the Crucifixion the sofa and rocking chair in my dining room my silver ink stand and candle sticks and the writing table on which they stand and my gold watch
  • To my son in law the said Edward Steer Hodson my spode guinea and the arm chair in my drawing room.
  • To my son in law the said Thomas Wilfred Haughton my diamond scarf pin and the whole of the furniture and appointments in or belonging to my dining room except such of them as are hereinbefore otherwise disposed of.
  • To my grand daughter and god child Elizabeth Frankland Haughton my silver tea and coffee service and my piano
  • To my friend and medical attendant John Descarrieres Ballance my silver battery inkstand
  • And to my maid Beatrice Montgomery my sewing machine
  • I bequeath all the rest and residue of my furniture plate linen china glass and other household effects and of my jewelry and trinkets and other personal effects to my two daughters the said Edith Livingstone Steer Hodson and Catherine Isabel Haughton in equal shares to be divided between them in such manner as they shall agree

I appoint my son the said Fitzwilliam John Carter Gillmor and my son in law the said Thomas Wilford Haughton (hereinafter called "my Trustees") to be the executors and trustees of this my will. I devise and bequeath all the rest residue and remainder of the real and personal estate which shall belong to me at the time of my decease or over which I may have any disposing power unto my Trustees Upon Trust to sell call in and convert into money the same and out of the moneys to arise therefrom to pay any funeral and testamentary expenses and debts and stand possessed of the residuary trust moneys and the investments for the time representing the same (hereinafter called "the said trust funds") In trust for my two daughters the said Edith Livingstone Steer Hodson and Catherine Isabel Haughton in equal shares as tenants in common Provided Always and I declare that my trustees shall retain the share of each of my daughters of and in the said trust funds upon trust to pay the income thereof to my same daughter during her life for her separate use without power of anticipation and from and after the decease of such daughter In trust for the female children of my same daughter who shall attain the age of twenty one years or marry under that age in equal shares and if there shall be only one such child the whole to be in trust for that one child and in case there shall be no female child of my same daughter who shall attain the age of twenty one years or marry under that age then In trust for my other daughter and so that the share accruing to such daughter under this trust shall be subject to the trusts hereby declared concerning the original share of the same daughter under this my will but in case both of my said daughters shall die without leaving any female child who shall attain the age of twenty one years or marry under that age then my trustees shall hold the said trust funds In trust for all the son or sons of my said daughters who shall attain the age of twenty one years the son or sons of each of my said daughters to take and if more than one equally between them the share of the said trust funds originally given to his or their mother and if there shall be only one son who attains a vested interest under this trust then the whole of the said trust funds shall be held in trust for such one son and I declare that my trustees shall have power to raise any part or parts not exceeding together the moiety of the expectant share of any grandchild of mine under this my will and apply the same for her or his advancement preferment or benefit as my trustees shall think fit but so that no such moneys shall be raised and applied as aforesaid during the existence of any prior interest or interests therein under this my will without the consent in writing of the person or persons having such prior interest or interests and I also declare that my trustees may in their absolute and uncontrolled discretion postpone the sale and conversion of any real and personal estate or any part thereof for so long as they shall think fit notwithstanding that the property the sale or conversion whereof shall be so postponed may be of a nature not authorised as an investment under this my will or may be situate out of the United Kingdom and I declare that the rents and income to accrue from and after my decease of and from such part of my estate as shall for the time being remain unsold and unconverted shall after payment thereout of all incidental expenses and outgoings be paid and applied to the person or persons and in the manner to whom and in which the income of the proceeds of such sale and conversion would for the time being be payable or applicable under this my will if such sale and conversion had been actually made and as regards any real property remaining unsold the powers conferred by section 63 of the settled land act 1882 (except the power of sale) may be exercised without the leave of the court notwithstanding section 7 of the settled land act 1884 and I declare that all moneys liable to be invested under this my will may be so invested in or upon any stocks funds or securities of or guaranteed by the Government of the United Kingdom or of any British Colony or depending or in stock of the Bank of England or the debentures or debentures stock or guaranteed or preference stock or shares of any railway or other company in Great Britain or India incorporated by act of Parliament or Royal Charter and paying a dividend on its ordinary stock or shares in the purchase or upon mortgage of real or heritable or leasehold property in England but not elsewhere such leasehold property being held for a term whereof sixty years at least shall be unexpired at the time of such investment and so that any property purchased as aforesaid shall be subject to the trust and provisions of this my will as if the same had formed part of my estate at my death and I declare that my trustees shall have full power to make partition of any part of my estate which may be held jointly or in common and to pay or receive any sum or sums of money by way of equality of position.

Signed by the above named Elizabeth Jane Buchan Gillmor as her last will in the presence of us both being present at the same time who in her presence and in the presence of each other have hereunto subscribed our names as witnesses.
