.

I, HILDEBRAND AUBREY HARMSWORTH of 3 Marlborough Gate Hyde Park in the county of London Baronet hereby revoke all former wills and testamentary dispositions made by me and declare that this is my last will.

  1. I appoint my son Chamberlain Michael Hildebrand Harmsworth and Frederick Omar Griffiths Lloyd of the Copse House near Farnham Surrey (hereinafter called "my executors") to be the executors of this my will
  2. I bequeath the following legacies free of all duties whatsoever
    (a) to my wife Kathleen Mary Harmsworth all my personal chattels as defined by the administration of Estates Act 1925 absolutely.
    (b) to each of my said executors who shall prove this my will the sum of one thousand pounds
  3. I devise to my said wife all my real estate (including all entailed realty of which I may have power to dispose by will) absolutely.
  4. I direct my executors after payment of my debts and funeral and testamentary expenses and of the legacies given by this will or by any codicil hereto and of all duties payable thereon to divide the whole of the remainder of my personal estate (including all entailed personalty of which I may have power to dispose by will) into ten equal parts and to pay and transfer
    (a) five of such ten equal parts to my said wife absolutely
    (b) four of such ten equal parts to all such of my sons as shall be living at my death in equal shares absolutely
    (c) one of such ten equal parts to Merton College Oxford University Upon trust to create therewith five scholarships tenable for two years each which shall be known as "Hildebrand Harmsworth Scholarships" and which shall be available only for British subjects who are Protestants and whose parents and paternal grandfather and great grandfather are or were both British born subjects and Protestants and for no other persons whomsoever All other conditions relating to the said scholarships shall be submitted to and approved by my executors.
  5. I declare
    (a) That my executors shall have power in their absolute discretion to postpone or omit the conversion into money of any part or parts of my estate and to distribute any such part or parts in its original form subject to a valuation thereof by a valuer to be selected by my executors
    (b) That the receipt of the Bursar for the time being of Merton College Oxford after the conditions of the said scholarships shall have been finally settled and approved by my executors shall be a sufficient discharge to my executors for the purpose of clause 4 (c) hereof
    (c) That any of the beneficiaries or any person claiming under them or any of them who shall institute any legal proceedings in respect of this my will shall forthwith absolutely forfeit all interest whatever to which he she or they might otherwise be entitled under this my will and such interest shall be divided equally among such of my sons living at my death as shall not have instituted such proceedings but without prejudice to any payments made or acts done before the institution of such proceedings
    (d) That my executor being a solicitor or other person employed in any profession or business may be so employed or act and shall be entitled to charge and be paid all professional or other charges for any business or act done by him or his firm in connection with this my will including acts which an executor could have done personally.
  6. It has always been my desire to have left considerable sums to charities but owing to the terrible state of taxation and the exorbitant rate of death duties such desire has been entirely crushed causing charity to start at home and I feel I can now only look after my own personal family.

In witness whereof I have hereunto set my hand this twenty fifth day of July one thousand nine hundred and twenty eight.
