Will of John J. Hayes from Newfoundland will books volume 15 pages 3-4 probate year 1929
(The interlineation referred to in the witnesses' declaration at the end of this will, is in item 2 where the name, Madeline, replaces the name, Mary)

IN RE.                         DECEASED.
JOHN J. HAYES

THIS is the last will and testament of me John J. Hayes of Saint John's in the island of Newfoundland Retired Butcher.

  1. I give and bequeath to my daughter Mary Hayes of St. John's aforesaid spinster the sum of Three hundred dollars.
  2. I give devise and bequeath to my two daughters Madeline Hayes of Saint John's aforesaid spinster and Kathleen Hayes of the same place spinster that piece or parcel of land situate on the North side of the Blackmarsh Road bounded on the south by the said Blackmarsh Road, on the west by land of John Hayes Junior; on the north by land of said John Hayes Junior; on the east by land of Richard Fitzpatrick in equal shares absolutely and forever; the said Mary Madeline Hayes to have the Eastern half thereof.
  3. I give devise and bequeath to my children Aileen Hayes of St. John's aforesaid spinster; Richard Hayes of the same place Shoe Maker; Thomas Hayes of the same place Sailmaker; James Hayes of the same place Truckman; and John Hayes of the same place Shoe Maker; the two pieces or parcels of land situate on the north side of the Blackmarsh Road aforesaid conveyed to me by Howard J. McDougall and Francis McDougall Executors of the will of Alexander McDougall deceased by Conveyances dated the nineteenth day of May Anno Domini one thousand nine hundred and twenty five and the sixteenth day of June Anno Domini one thousand nine hundred and twenty five respectively in equal shares absolutely and for ever.
  4. I give devise and bequeath to my children the said Eileen Hayes the said Richard Hayes; the said Thomas Hayes; the said James Hayes; and the said John Hayes; that piece or parcel of land situate on the north side of the Kenmount Road comprised in a Grant from the Crown to me Number 7080 dated the thirty-first day of October one thousand eight hundred and ninety two and registered in Volume 46 Folio 70 of Registry of Crown Grants in equal shares absolutely and for ever.
  5. I give devise and bequeath to my said children the said Aileen Hayes the said Richard Hayes; the said Thomas Hayes; the said James Hayes; and the said John Hayes that piece or parcel of land situate at Bay St. George comprised in a Grant from the Crown to me dated the 3rd day of January Anno Domini one thousand eight hundred and ninety eight Number 8438 in equal shares absolutely and forever.
  6. All the rest residue and remainder of my property estate and effects of every kind or description wheresoever situate I give devise and bequeath to my children the said Aileen Hayes, the said Richard Hayes; the said Thomas Hayes; the said James Hayes; and the said John Hayes in equal shares absolutely and forever.
  7. I appoint my said son Richard Hayes executor of this my last will and testament.

WITNESS my hand at Saint John's aforesaid this 3rd day of July Anno Domini one thousand nine hundred and twenty nine.

SIGNED PUBLISHED AND DECLARED by the said testator as and for his last will and testament in the presence of us who at his request in his presence and in the presence of each other (all present at the same time) have hereunto subscribed our names as witnesses, and that the interlineation identified by our initials F.M. and A.O.D.K. were first made.
