Will of Thomas Hayes
from Newfoundland will books volume 9 pages 323-327 probate year 1911

In re
      Thomas Hayes          deceased.

      This is the last will and Testament of me Thomas Hayes of Saint John’s in the Island of Newfoundland Furrier. I give devise and bequeath unto my Eldest son John Hayes all that piece and parcel of land situate on Black Marsh Road now occupied by him together with all Erections thereon and bounded as follows on the north East by land belonging to one Wills on the north East side of the River - on the west by land belonging to the said Wills on the north by land belonging to Chauncey and Mullins. On the south and west by land of me Thomas Hayes for his own absolute use and benefit. I also give devise and bequeath twelve feet of land situate on Pleasant Street and bounded as follows on the west by land of me Thomas Hayes - on the East by land of Thomas Peyton - on the south by Horwood’s Lumber Yard to my said son John Hayes for his own absolute use and benefit. I also give devise and bequeath one half of that piece of meadow land situate on the road off Freshwater Road leading to the Cottage of the Honorable James Baird to my said son John Hayes for his own absolute use and benefit -

I give devise and bequeath the other half of the said land being the western half of the land on the road off the Freshwater Road unto my son Richard Hayse for his own absolute use and benefit. I give devise and bequeath unto my said son Richard Hayes all that piece and parcel of land situate on New Gower Street together with Dwelling House and other Erections thereon, now occupied by Joseph McCarthy for his absolute use and benefit I also give devise and bequeath unto my said son Richard Hayes all that piece and parcel of land upon which the Dwelling House he now occupies stands together with the said Dwelling House and all rights easements and appurtenances now enjoyed by him and appertaining to the said house.

I give devise and bequeath unto my son Thomas for his absolute use and benefit all that piece of land with Dwelling House thereon Situate on Waldegrave Street in Saint John’s aforesaid and now occupied by me. I also give and bequeath unto my grand daughter Mary Hayes daughter of my said son Thomas Hayes the piano now in my house on Waldegrave Street I give devise and bequeath unto my said son Thomas Hayes all that piece of land situate on the Black Marsh Road bounded south by the Black Marsh Road and west by land belonging to Mullins I also give devise and bequeath unto my said son Thomas Hayes all that piece of land situate on Black Marsh Road and measuring twenty nine acres and over purchased from Doctor Campbell.

I give devise and bequeath unto my son Michael Hayes all that piece of land and Dwelling House situate on Waldegrave Street aforesaid and occupied in the winter by said son Richard Hayes and I direct that the said House shall neither be sold nor mortgaged by my said son Michael Hayes - I also give devise and bequeath unto my said son Michael Hayes all the land Houses stores and other property of mine in Stephenville Bay St. George now in the occupancy of the said Michael Hayes for his own absolute use and benefit.

I give devise and bequeath unto my son James Hayes all lands Houses Stores and other property belonging to me situate in Bay St. George for his own absolute use and benefit with the Exception of the piece of land containing fourteen acres more or less situate at Seal Rocks Bay St. George between the Roman Catholic Church property and the Church of England property.

I give devise bequeath the said piece of land measuring fourteen acres more or less situate at Seal Rocks aforesaid unto my said son John Hayes.

I give devise and bequeath unto my daughter Catherine married to John Joy of Bay St. George all that piece of land situate at Stephenville together with Houses stores and other property now in the occupancy of the said John Joy. I also give devise and bequeath unto my said daughter Catherine Joy for her own absolute use and benefit all that piece of land situate on Pleasant Street aforesaid measuring on Pleasant Street aforesaid eighteen feet and bounded by land of mine on the East and by Horwoods Lumber Yard in the rear. I also give and bequeath unto my said daughter Catherine Joy the sum of six hundred dollars now in the Savings Bank and I direct my Executor hereinafter named to see that this money is placed in the Savings Bank for the purpose of assisting my said daughter Catherine Joy in building a Dwelling House on said land on Pleasant Street.

I give devise and bequeath unto my wife during her life time, the land and House situate on Pleasant street aforesaid now occupied by my daughter Bridget wife of James Callahan, and after my said wifes death I give devise and bequeath the said land and House to my said daughter Bridget Callahan the said Bridget Callahan to pay Eighty dollars a year for the first five years after my said wifes decease unto my Executor and these rents to be placed in the Savings Bank for my said daughter Catherine Joy to add to the six hundred dollars heretofore bequeathed for the purpose of aforesaid mentioned

I give devise and bequeath unto my said son Thomas Hayes the land and House thereon and front garden and all ways thereto situate on Black Marsh Road and adjoining the House now occupied by Richard Hayes, my said son, and being the house, my Country house I am now living in.

I give devise and bequeath unto my said son Richard the land and store on Pleasant Street in the rear of the land bequeathed to my said son John Hayes. I hereby direct that the land in the rear on Pleasant Street bequeathed to my son John Hayes is not to Exceed more than fifteen feet to him.

I hereby direct that my executor shall sell the two houses and land at River Head in St. John’s aforesaid belonging to me and shall divide the proceeds thereof between my said five sons John    James    Thomas    Richard and Michael Hayes Equally.

I give devise and bequeath unto my wife Bridget the sum of Two hundred dollars a year for her support. I direct that the residue of my estate shall be equally divided between my said five sons John James Thomas Richard and Michael Hayes. I hereby appoint my said son Thomas Hayes sole Executor of this my will & Testament Dated this 28th day of August. A.D. 1911. Thomas Hayes Signed by the Testator Thomas Hayes in our presence who in his presence and in the presence of each other hereto subscribe our names as witnesses Hugh H. Carter     Amelia Hayes
