Will of Jordan Henderson In re In the name of God Amen, I Jordan Henderson of Harbor Grace in the Island of Newfoundland Merchant being infirm of body but of perfect mind and memory do make and ordain this my last will and testament as touching such worldly estate as I may be possessed of at the time of my decease I give demise and dispose of the same in the following manner and form First I give and bequeath to Elizabeth my dearly beloved wife the sum of Fifty pounds yearly for her maintenance to be raised and levied out of my estate and paid her annually by my executor for and during the full time and term of her Widowhood and no longer and in case she should again enter into wedlock I do hereby revoke the said grant and order that from thenceforth she shall not be entitled to any part of my property whatever. The remainder of my estate real and personal I give and bequeath to my two children Joanna and William but to be held in trust by my brother Bethel Henderson for them till they shall arrive at such age as he shall consider most proper for them to receive the same and then to be divided in such proportions to each as he shall consider they deserve. And I do hereby appoint my aforesaid wife Elizabeth to be the Guardian of my children and require and insist that they shall be sent to such part of Great Britain as shall be directed by my executor to be there educated the expenses of which and the charges of their maintenance to be paid out of my estate by my executor, but this trust of being Guardian is reposed in her only for and during her state of Widowhood and should she again marry I do hereby revoke the said Trust committing it into the hands of my executor hereinafter mentioned.
And I do hereby appoint my well beloved brother Bethel Henderson aforementioned to be sole executor to this my last will and testament and do hereby empower him to settle all my temporal affairs and to apply the neat proceeds of my estate to the uses hereinbefore mentioned. And I do hereby utterly disallow revoke and disannul all and every other former testaments wills legacies bequests and executors by me in any ways before named willed and bequeathed ratifying and confirming this and no other to be my last will and testament. Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor. We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be. |
