Will of Cyrus Hillier, from Newfoundland will books volume 15 pages 84 & 85probate year 1930

CYRUS HILLIER.

This is the last will and testament of my Cyrus Hillier of Lamaline in the Southern District of Newfoundland fisherman.
It is my will that all my just debts and funeral and testamentary expenses be paid by my executor hereinafter named as soon as conveniently can be after my decease.

I give devise and bequeath the whole of my real and personal estate as follows vis:
(1)      I give devise and bequeath all my share of the property which was willed to me and my cousin John Robert Hillier by my late Uncle William Hillier to my said cousin John Robert Hillier except my share of the Beach situate "Back of the Beach" Meadow Lamaline aforesaid and willed to us as aforesaid, Which I hereby devise and bequeath to my cousin Harold E. Hillier.
(2)      I give devise and bequeath my fishing shed and capstan situate "Back of the Beach" to my friend James Hooper, the shed to be removed from the Beach, unless John Robert Hillier allows it to remain there.
(3)      I give devise and bequeath unto John Hooper, son of James Hooper, a piece of Beach situate between between Chesley Hilliers and the late William Ayers Beach Situate on the south side of the road leading to the Meadows Bridge.
(4)      I give devise and bequeath unto my nephew Sydney Madigan my potatoe Garden situate near "John Sticklands Pond" meadow aforesaid, also one bed and bedstead, together with the sum of one hundred and fifty dollars in cash.
(5)      I give devise and bequeath unto Catherine Leah Hooper all the rest and residue of my estate comprising dwelling house with all its contents (save and except the bed and bedstead herebefore bequeathed to Sydney Madigan) also land surrounding said house and outhouses, also Motor Dory and all fishing gear together with all money or securities for money that I may die possessed of (save and except the one hundred and fifty dollars hereto before bequeathed to Sydney Madigan)
6.      And it is my will that my executor hereinafter named is to erect two headstones one to myself and another to my late father and mother the said stone to cost about Seventy five dollars each not including cost of cement etc for erection.
7.      And it is my will that James Hooper and Lucy Hooper and and ??? Catherine Leah Hooper to manage ?? the estate until she attains the age of eighteen years or should marry before that time.
(8)      And lastly I constitute and appoint my cousin Harold E. Hillier executor of this my last will and testament.

In witness whereof I have hereunto my hand and seal subscribed and set at Lamaline aforesaid this twenty third day of September anno domino nineteen hundred and twenty nine.
