Joseph Jeffers

Disclaimer: The wills for volumes 1 and 2 are not made from the original will books, but rather from a set of books written up from the originals about 100 years later. The 1846 hand written will book that we are putting up along with the wills from the volume 1 will book, is not the original will book. It was made, probably within a decade of the death of the testators, but it is not an exact replication from the original will book.

 

Will of Joseph Jeffers
from Newfoundland will books volume 1 pages 495 & 496 probate year 1846

In re Joseph Jeffers      deceased.

In the name of God Amen. This is the last will and testament of Joseph Jeffers of Freshwater in Conception Bay Newfoundland.

  • Item, I give and bequeath my soul to God who gave it hoping for the forgiveness of my sins through the atoning sacrifice of Christ and I also bequeath my body to the earth to be decently buried by my executors.
  • Item, I give and devise unto my wife Elizabeth Jeffers during her natural life and so long as she shall continue to be a widow, all and singular my room gardens and plantation situate in Freshwater together with the dwelling house now occupied by me.
  • Item, I give and bequeath also to my wife Elizabeth Jeffers during her natural life and so long as she shall continue to be a widow, all my personal estate of what nature and kind soever, household furniture money goods and chattels for her support and sustenence.
  • Item I give and devise unto Elizabeth Jeffers Penny daughter of John Penny the dwelling house occupied at present by her father to be by her father John Penny held in trust for her and as her guardian untill she be of age the said dwelling house and the land on which it stands to be her the said Elizabeth Jeffers Penny and her heirs for ever and half the potatoe garden eastern half on the south side of the road by the water.
  • Item, After the death or demise of my wife the said Elizabeth Jeffers or in case she should marry again after my decease I give and devise the dwelling house I now occupy with the fishing room gardens and plantations belong to me and situate in Freshwater aforesaid to Thomas Homer son of Nancy Homer and Joseph Jeffers son of Samuel Jeffers as coparceners(?) and to be held and occupied by them as joint-tenants and to the heirs of the survivor of them forever.
  • Item, the remainder that may be left of my personal estate after supporting my said wife during her natural life or as long as she shall continue a widow I give and bequeath to my brother's daughter Elizabeth Parsons, my sisters Elizabeth Clarke, Mary Clarke and Nancy Homer and to William Joyce. The said property vizt money, goods, chattels and personal effects of every kind soever to be realised and equally divided amongst the said five persons. I appoint Mr. George Joyce and Mr. Phillip Vatcher my executors, and Thomas Newell Senr my executor also.

Signed sealed published and delivered by the said Joseph Jeffers the testator as his last will and testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses this eighth day of June in the year of our Lord one thousand and eight hundred & forty six. In the name of God, Amen. This is the last will and testament of Joseph Jeffers of Freshwater in Conception Bay Newfoundland.

This deponent Thomas Newell of Carbonear Gentleman maketh oath and saith that he this deponent was present and actually saw Joseph Jeffers the Testator within named, sign seal and deliver the within paper writing as and for his last Will and Testament on the day of the date thereof at which time also this deponent together with George Joyce and Phillip Vatcher subscribed their names thereto as witnesses attesting the due execution thereof. T. Newell.
Sworn to at Harbour Grace this 28th day of October A.D. 1846.

(Thomas Newell was obviously one of the witnesses to the original will, but the court clerk did not list his name as a witness in the will book.)

 

 

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
