Will of John King
from the Newfoundland will books volume 12 pages 385 & 386 probate year 1923

In re JOHN KING.      DECEASED.

I, John king, son of Oliver, of Broad Cove in the Electoral District of Bay De Verde in the Island of Newfoundland, being of sound mind and memory, do make and publish this my last Will and Testament in manner and form following, that is to say:

  1. I give, devise and bequeath to my beloved wife Catherine King, half my dwelling house with the furniture therein, half my Stable, and half my Cellar, and the land on which the same are erected with the right of way thereto: the cabbage garden on the back of the house: the lower part of the meadow in front of my Dwelling house: the lower part of the meadow in front of my Dwelling house: the upper or N. W. Part of the garden known as the Wood's garden: half the flake and half the land on which the flake is erected and bounded on N. By Alice J. Legrow's land, on S. By Jabez Legrow, on E. By the Cliff and on W by Silas King, to be hers so long as she remains a widow, and in the event of her decease or marrying again the said bequests to go to my son John Charles King.
  2. I give devise and bequeath to my beloved wife, Catherine King, my bed and bedding to be hers absolutely.
  3. I give, devise and bequeath to my son Oliver King the garden known as Butt's garden: half the flake and half the land on which the said flake is erected and bounded as in bequest No. 1: the piece of potato ground in N.E. Corner of garden, known as Wood's garden, containing the setting of one barrel of seed potatoes.
  4. I give to my son Hugh King the piece of land in Woods garden and bounded on N. By Silas King, on S. By Jabez Legrow on E. By Silas King and on West by path.
  5. I give to my son George King the piece of land at Broad Cove North and bounded as follows: on W. By Noftle's road, on N. By main line, on S. By John Legrow's land, on E. By Adam Legrow. And last; I hereby constitute and appoint Peter L. Legrow Esq. To be the Executor of this my last Will and Testament.

In witness whereof I have hereunto set my hand this 29th day of January A.D. 1915. JOHN his X mark KING of Oliver
Signed published and declared by the above named John King of Oliver (by making his mark) in presence of us, who, at his request, have signed as witnesses of the same (the said will having been first read over and explained to the said John King who seemed fully to understand and approve of the same) Witnesses. Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
