Last will and testament of
Thomas Lawler of St. John's
Yeoman deceased
.

In the name of God Amen I Thomas Lawler of St. John's in the island of Newfoundland Yeoman, do make publish and declare this paper writing to be my last will and testament and I hereby annul and make void all former wills by me made or executed. First I give devise and bequeath unto my daughter Mary Ellen wife of George O'Rielley all my right title and interest of in and to the dwelling house, the land upon which said dwelling house is built and the land in connection therewith to which I am entitled.
The foregoing bequeathed property together with the adjoining property being held under lease from the late Right Revd. Dr. Mullock to the late Edward Roache and myself: the late Edward Roache and I having agreed to a partition of said property and the portion I herein bequeath being the share or part to which I became entitled: but in case of the death of my said daughter Mary Ellen O'Rielley without leaving lawful issue then and in such case the aforesaid property shall become and is hereby bequeathed to the children of my brother-in-law Patrick Roache and the late Edward Roache. Second I give devise and bequeath unto my said daughter Mary Ellen O'Rielley all my right title and interest of in and to the dwelling house and land situate on South West Street in St. John's aforesaid and leased from Ellis's estate to be disposed of as she may direct. Third I give devise and bequeath unto my said daughter Mary Ellen O'Rielley all my right title and interest of in and to the house and land situate on North Street in St. John's aforesaid and leased from Ellis's estate subject to the conditions and obligations herein imposed. Now the conditions of the third bequest are that my said daughter Mary Ellen O'Rielley to whom I hereby give authority to dispose of said property (subject to the obligations and conditions hereinafter named) shall in the fall or say the month of October and in the spring say month of April in each and every year for the period of thirty years from the date of my decease will and truly pay or cause to be paid unto my son William and his children or to the survivors of them the sum of forty dollars yearly such sum however I direct shall not be paid in cash but its equivalent to be given in provisions in the following manner that is to say - twenty four dollars worth of provisions in the fall say the month of October and sixteen dollars in the spring (provisions as aforesaid) say in the month of April. The said sum of forty dollars being hereby understood to be a yearly not a half yearly payment. I desire it to be distinctly understood and I hereby direct that my said daughter Mary Ellen O'Rielley shall only be liable and responsible for the payment of said sum of forty dollars in manner aforesaid provided she my said daughter Mary Ellen O'Rielley shall receive rent sufficient under this the third bequest to meet the obligations and conditions aforesaid. And in case the said dwelling house should be by fire or otherwise destroyed then and in such case the foregoing conditions and obligations shall cease determine and become void she my said daughter Mary Ellen O'Rielley being hereby relieved from all liability under the third bequest under this my will and I hereby give her full power and authority to use or dispose of as she may direct free from the conditions and obligations aforesaid the land leased as aforesaid from Ellis's estate on North Street aforesaid. Fourth I give devise and bequeath all other property of every description that I may die possessed of unto my said daughter Mary Ellen O'Rielley to be disposed of as she may direct. Fifth. I hereby nominate and appoint my brother-in-law Patrick Roache sole executor of this my last will and testament. In witness whereof I have hereunto my hand and seal subscribed and set at St. John's aforesaid this twenty second day of December A.D. 1890.
