In re DECEASED.
WILLIAM LITTLE.
ON THIS Third day of May one thousand nine hundred and
twenty, BEFORE us Mtres HENRY FRY and ROBERTSON
WALTON GIBB the undersigned Notaries Public for the province of
Quebec, practicing in the city of Montreal APPEARED WILLIAM LITTLE of
the city of Westmount, Lumberman; Who being in good health
of body and of sound and disposing mind as appeared unto us, declared unto
us, the said Notaries, his LAST WILL AND TESTAMENT as
follows.
First I desire all my just debts and my funeral and testamentary
expenses to be paid by my Executors as soon as possible after my death, and
I direct them to pay all Succession Duty payable in respect of my Estate without
delay.
Second I give, devise and bequeath all the property real
and personal moveable and immoveable, wheresoever situate, of which I may die
possessed to my sister Dame Margaret Jane Little, widow of the late Honourable
Edmond Henry Spring-Rice, my brother Leonard Greenham Little and my niece Theodosia
M. Spring-Rice, Doctor of Osteopathy, to be divided among them in the following
proportions, namely, forty per cent or four parts each to my sister and brother
and twenty per cent or two parts to my said niece.
THIRD.. This bequest is made for the alimentary support
of the legatees, and upon condition that no part of my estate, either in capital
or revenue, shall be liable for their debts or to be seized or attached for
any reason, which provision shall not however prevent the Legatees from hypothecating
property voluntarily, such debts being excepted from this condition and the
shares of my sister and niece are for their separate use and shall not either
in capital or revenue fall into any Community of Property which may exist between
either of them and any husband whom she may marry.
Fourth. To execute my will I name as executors my sister
the said Mrs. Margaret Jane Little or Spring-Rice, my brother the said Leonard
Greenham Little and my niece the said Theodosia M. Spring-Rice, whose powers
as such I extend beyond the year and day and so long as anything remains to
be done in connection with my estate. I give them the seizin and possession
of all my property, moveable and immoveable, and power to sell or otherwise
dispose of the same in such manner for such price and upon such terms and conditions
as they may see fit, and they may compromise claims both in favor of and against
my estate.
While there are three executors a majority may act and
in any way bind my estate. They need not give security in any Province, State
or Country.
Fifth. I revoke all former wills and declare this to be
my LAST WILL AND TESTAMENT.
THE PRESENT LAST WILL AND TESTAMENT was thus executed at
the city of Montreal on the date herein above first written and remains of
record in the office of the said Mtre Fry under the Number Sixteen thousand
four hundred and fifty seven.
And after these presents had been duly
read to the testator by the said Mtre. Fry in the presence of his Colleague,
the testator signed these presents in the presence of the said Notaries, who
in his presence, at his request and in the presence of each other have also
signed.
