Will of Donald MacRae

In re
      Donald MacRae          deceased.

      This is the Last will and Testament of me, Donald MacRae of the City of Saint John, in the City and County of Saint John, and Province of New Brunswick, Clergyman It is my will and desire that all my just debts, funeral and Testamentary expenses be paid out of my estate:
One, I give, devise, bequeath and declare to be apportioned to my son Alexander W MacRae, the insurance moneys that may be payable under two certain policies of insurance upon my life issued by the Canada Life Assurance Company and numbered 41705 M/I and 10476 A/I respectively:
Two I give devise bequeath and declare to be apportioned to my son Kenneth J. MacRae the insurance money that may be payable under a certain policy of insurance upon my life issued by The New York Insurance Company and numbered 217161.
Three This is my will and desire that all moneys and securities held in trust for me at the time of the making of this will, by my son Kenneth J. MacRae together with any other moneys and securities for money which I may hold at the time of my death shall be divided into three equal parts, and that one third thereof shall be given to my daughter Silla I. Campbell, one third to my daughter Violet D. MacRae and one third in equal proportions to my grand daughters Silla McKenzie, Jean McKenzie and Elizabeth Violet McKenzie, children of my deceased daughter Elizabeth J. C. McKenzie, Provided always that each of the said one third parts of moneys and securities payable to the aforesaid Legatees shall not exceed Two Thousand Dollars and should there be any amount over and above Six thousand dollars ($6,000.00) in moneys and securities, it is my will and desire that the balance be divided equally amongst my grand children other than the said Silla McKenzie, Jean McKenzie and Elizabeth Violet McKenzie, children of my deceased daughter, Elizabeth J. C. McKenzie.
(Four) I give, devise and bequeath to my son Alexander W. MacRae the clock received from me from my father, and also my Family bible:
(Five) I give, devise and bequeath to my son Kenneth J. MacRae the Breeches Bible, belonging to me:
(Six) I give, devise and bequeath to my son Archibald O’ MacRae and any other of my sons who at the time of my death or within three years thereafter may be ordained to the ministry of the Presbyterian Church of Canada, all the Theologic papers and works of which I may die seized or possessed;
(Seven) I give, devise and bequeath all the remainder of my estate to my sons Alexander W MacRae, Kenneth J. MacRae, Archibald O. MacRae, John J. MacRae; Donald N. MacRae and Colin C. MacRae share and share alike; I nominate and appoint my sons Alexander W MacRae and Kenneth J. MacRae Executors of this my last will and Testament: In Testimony whereof I have hereunto set my hand and seal at the City of Saint John in the City and County of Saint John this twenty eighth day of June in the year our Lord one Thousand nine hundred and six (sgd) Donald MacRae (LS) Signed sealed published and declared as and for his last will and Testament by the above named testator Donald MacRae in the presence of us who at his request and in his presence and in the presence of each other all three being together at the one time have hereunto subscribed our hands as witnesses (sgd) Sherwood A. M. Skinner. (sgd) John A. Sinclair

This is a Codicil to the last will and testament of me, Donald MacRae, of the City of Saint John in the City and County of Saint John, Clergyman, bearing date the twenty eighth day of June in the year of our Lord one thousand nine hundred and six. In case my daughter Violet D. MacRae survive me and is at the time of my death unmarried, it is my will and desire that the division of my estate by the third paragraph of said will and testament be postponed until the marriage or death of my said daughter Violet D. MacRae whichever may first happen and that in the meantime my executors named in said last will and testament shall hold the moneys and securities for money in said paragraph mentioned unimpaired, upon trust to pay the entire income arising therefrom to my said daughter Violet D. MacRae, while she shall live and remain unmarried and upon the death or marriage of my daughter Violet D. MacRae, it is my will and desire that the provisions of my said will shall come into effect, and that in the case of the death of my said daughter Violet D. MacRae, unmarried, the moneys provided to be paid to her under said will shall go to such persons or persons as she by will shall appoint, and in case she failed to make any such appointment one half of said share shall go to my daughter, Silla I. Campbell or in case of her previous death to her daughter Mary Campbell, if living and in case her said daughter be not living to the surviving children of my said daughter Silla I. Campbell, share and share alike. And one-half of said share to the daughters of my deceased daughter Elizabeth J. C. McKenzie     In all other respects I do confirm my said will In Testimony whereof I have hereunto set my hand and seal at the City of Saint John in the City and County of Saint John, in the Province of New Brunswick this eighteenth day of March in the year of our Lord one thousand nine hundred and eight (sgd) Donald MacRae (LS) Signed Sealed Published and Declared as and for his last will and Testament by the above named testator Donald MacRae in the presence of us, who at his request and in his presence and in the presence of each other, all three being together at the one time have hereunto subscribed our hands as witnesses. (Sgd.) John A. Sinclair (sgd.) Wm A Dougherty Jr.

A Codicil made this sixteenth day of October, 1909. The half of all I possess at the time of my decease I hereby bequeath and will to my daughter Violet D. MacRae. I bequeath this half of my money and effects being in my ordinary health and in full possession of all my faculties, By the expression “I possess”, I mean all my money and effects of every description. This codicil alters and changes to this extent any will or codicil I may have made heretofore. All books which I have already disposed of are not to be considered as part of my effects. (Sgd) D.
