Will of Mary McCarthy
from Newfoundland will books volume 2 pages 311-312 probate year 1858

In re
     Mary McCarthy      deceased.

In the name of God Amen.     I Mary McCarthy of Carbonear Widow of the late Felix McCarthy being of sound and disposing mind memory and understanding but mindful of my mortality do this fifteenth day of May in the year of our Lord one thousand eight hundred and fifty-seven make ordain and publish this my last will and testament in manner and form following that is to say I give and bequeath to my sons Felix McCarthy and Richard McCarthy their heirs and assigns for ever the Brig "True Blue" and all my household furniture Cattle and whatever property I may be possessed other than what I have here given and bequeathed together with all monies bills notes debts I may have in my possession or may be due or owing to me or that I may claim at the time of my death And I do hereby ordain constitute and appoint my said son Felix McCarthy sole executor of this my last will and testament hereby revoking all former and other wills and testaments by me at any time heretofore made In witness whereof I have to his my last will and testament set and subscribed my hand and seal the day and year first above written. Signed sealed published and declared by the said testatrix Mary McCarthy as and for her last will and testament in the presence of me who at her request in her presence and in the presence of me have hereunto subscribed my name as witness thereto, James L. Prendergast.
Codicil
- Be it known to all men by these presents that I Mary McCarthy of Carbonear Widow of the late Felix McCarthy have made and declared my last will and testament in writing bearing date the fifteenth day of May in the year of our Lord one thousand eight hundred and fifty seven; I the said Mary McCarthy by this present codicil do ratify and confirm my said last will and testament and do further give and bequeath unto my son John McCarthy the sum of one hundred pounds currency of good and lawful money to be paid to him the said John McCarthy by my executor out of my estate;     I also bequeath unto His Lordship the Right Revd Dr. Dalton the sum of fifteen pounds currency and I also bequeath to the Revd. Superioress of the Carbonear Convent the sum of five pounds and to Dr. Berney six pounds And my will & meaning is that this codicil be adjudged to be a part and parcel of my last will and testament and that all things therein mentioned and contained be faithfully and truly performed and as fully and amply in every respect as if the same were declared and set down in my said last will and testament

Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
