Last Will and Testament of
Thomas McCormack of Catalina
Merchant deceased.
I Thomas McCormack, of Catalina in the District
of Trinity in the Island of Newfoundland, Merchant hereby revoke all former
wills and testamentary dispositions by me at any time made, and declare this
to be my last will and testament: and I appoint John Murphy and John
White both of the firm of McCormack & Walsh, Catalina, to be the executors and
trustees of this my will. I give and bequeath to my executors all my property
to hold upon the trusts following
First, out of my ready money and
my money on deposit in the Bank of Montreal at St. John's to pay my debts and
testamentary and funeral expenses and to expend the sum of $400.00 on masses
for the repose of my soul: Second, To place on deposit in the Bank
of Montreal aforesaid the remainder of my money, and to pay the income arising
thereout to my wife during her life. Third. After the death of my
wife, to call in the said sums deposited and to pay thereout the sum of $400.00
for Masses for the repose of her soul and the following legacies, namely: to
the following persons $400.00 each, my nephews John, Patrick and James
McCormack,
and my niece Margaret Maloney, my wife's nephew Nicholas
White and her niece
Kate Kehoe, the Reverend John Lynch and James Conroy, grandson of Judge
Conroy;
To the following Roman Catholic Convents $100.00 each; the convent at Carbonear
Harbor Grace, St. John's (Riverhead) St. John's (Littledale) St. John's (Belvidere)
St. John's (Military Road) Conception Harbor, Brigus and Harbor Main: And to
the Mount Cashel Orphanage at St. John's the sum of $400.00.
Fourth,
After the death of my wife to divide between themselves in the proportions
hereinafter mentioned, and thenceforth to hold to their own uses my share or
interest in the said business of McCormack & Walsh and in the house at
Catalina now occupied by me together with the furniture therein the said John
Murphy taking two third parts thereof and the said John White taking one third
part thereof: And I direct that during the lifetime of my said wife she shall
be permitted to continue to reside in my said house and to use the furniture
therein contained.
Fifth, as to the residue of my estate after the
death of my wife not hereinbefore otherwise disposed of to pay the same to
the Roman Catholic Episcopal Corporation of Harbor Grace for the use of the
Parish of Bonavista, to be invested by the said Corporation, and the income
arising thereout to be divided equally between the settlements of Bonavista
and Catalina and to be expended for Roman Catholic School and Church purposes
only in the said settlements respectively.
