Will of James Miller
from Newfoundland will books volume 8 pages 569 to 571 probate year 1909

In re
      James Miller          deceased.

      In the Name of God Amen. I James Miller of Topsail South Shore in the Electoral District of Harbor Main Newfoundland, Cooper, being very Sick and weak in Body but of perfect mind and memory, do make and ordain this my last will and Testament    First I give and bequeath to my beloved wife Mary Ann and my daughter Julia Ann Miller, my dwelling house, goods and chattles kitchen garden, stable and the land that the stable is on. Also the store or sheep house by my dwelling house and all the land that my dwelling house and Store or sheep house are on and the land in the rear of my dwelling house except the cow pen for their Sole use and benefit. The said land is bound on the south by the main road north by the beach. East by James Moyse and west by Thomas Allen’s land. The cows pen is for the use of all my family and is bounded on the north. South and East by Thomas Allen and on the west by Millers road leading to the waterside - I also give and bequeath to my wife and my daughter Julia Ann all the cattle and sheep I may be possessed of at my death -

I give and bequeath to my son James all the land that his dwelling house and other erections are on. The land belonged to my father and as he gave it all to me so I give it all to my son James The said land is bound on the west by Charles Carter, north by main Road. East by William Boggan and south by Nathaniel Miller.

To my son Ananias I give and bequeath the land that his dwelling house and other buildings are on. The land was given to me by my father and as he gave it to me so I give it to my son Ananias. The said land is bound as follows, on the west by Joseph Miller, north by the beach, East by Millers road leading to the beach and south by Thomas Drawns -

That piece of Cultivated land situate in Topsail that is bound on the East by Robert Miller. West by Millers country road. North by Charles Carter and south by Robert Miller. I give and bequeath to my wife, my two sons James and Ananias and my five daughters to be equally divided between them. The building that is on the said land containing my sons agricultural implements I do not own they can remove it where they like -

My piece of land that is situated by the East Station road is to be divided in the following manner among my sons and daughters, my son James three acres, my son Ananias three acres. Elizabeth Miller three acres, Phoebe Butler three acres, Jessie Giles three acres, Julia Ann Miller three acres and Matilda Somerton three acres - The remaining part of that piece of land is for the use of all.    A road is to go through all the different pieces for the use of all. The said piece of land is bound in the following manner. East by public road, north by the rail track, south by George Smith and Nathaniel Smith And west by Allens river.

My Caplin sein and Caplin boat is for the use of my two sons. My box cart and wheels, iron plough, horse Catamaran and loose gear about the place is for the use of all - And I do appoint Mr. Francis F. Furneaux J.P. of Kelligrews sole Executor of this my last Will and Testament. And I do hereby utterly disallow revoke and disannul all and every other former Testaments, Wills, Bequests and Executors by me in any wise before named, willed and bequeathed, ratifying and confirming this and no other to be my last Will and Testament In witness whereof I have hereunto set my Hand and Seal, this 25th day of September in the year of our Lord one thousand nine hundred and eight    James his x mark Miller Signed Sealed published pronounced and declared by the said James Miller as his last will and Testament in the presence of us, who in his presence and in the presence of each other have hereunto subscribed our names as witnesses having been first read over    Francis F. Furneaux. J. P.     Charles Carter
