Will of Patrick Nowlan

Last Will and Testament of
Patrick Nowlan of Brigus
Merchant deceased.

      In the name of God Amen. I Patrick Nowlan of Brigus in Conception Bay but at present in St. John's Merchant do make publish and declare this as and for my last will and Testament.

First. I direct that all my just debts funeral and testamentary expenses shall be paid.

Second. I give devise and bequeath to my executors hereinafter named the sum of four hundred dollars in trust to invest the same in some good security at interest for the use and benefit of Gertrude daughter of Alexander J. Saunders and Bridget his wife to be paid to her when she attains the age of twenty one years or marries which ever event shall first happen.

Third I give devise and bequeath to my sister Bridget wife of the said Alexander J. Saunders the sum of Two hundred dollars

Fourth. I give devise and bequeath to the very Reverend Edward F. Walsh the now Parish Priest of Brigus aforesaid the sum of Three hundred dollars towards defraying the expenses of and attendant upon the erection of the New Roman Catholic Church at Brigus and the further sum of one hundred dollars for masses for the repose of my soul and the further sum of Two hundred dollars in consideration of the discharge by him of the duties of an executor of this my will.

Fifth. I give devise and bequeath to Maurice Fenelon of St. John's Bookseller and stationer the sum of Two hundred dollars in consideration of the discharge by him of the duties of an executor of this my will.

Sixth. I give devise and bequeath all my household furniture and effects of every sort to my daughter Bridget for her own use and benefit.

Seventh. As regards the rest residue and remainder of my estate property and effects of whatsoever nature or kind the same may be and wheresoever situate I give devise and bequeath the same to my executors hereinafter named in trust to permit and suffer my said daughter Bridget to have hold use recieve and take the same for and during her natural life with the right to her to occupy and use free of rent such of my houses lands and premises as she may desire and should she die leaving a child or children her surviving then upon trust to hold the said rest residue and remainder or so much thereof as may be then remaining in trust for such purposes and subject to such directions as my said daughter may by deed will or any other writing under her hand direct and appoint. And I do will and direct that should my said daughter require for the decent and comfortable support and maintenance of herself or of herself and family or for the education of her children or any of them any advances or payments from or out of the principal of the said residue as remainder it shall be in the discretion of my said executors or the survivor of them on being satisfied that necessity for so doing exists to make to her from time to time for the said purposes or any of them such reasonable advances or payments as they or the said survivor may think proper and I do hereby authorize and empower my said executors or the survivor of them to sell and dispose of any part or all of the said rest residue and remainder if in their or his judgment such sale or disposition be necessary or advisable in order to the making of such payments or advances or any of them and the receipts of my said daughter to my said executors or the survivor of them for such payments or advances shall be sufficient indemnity release satisfaction and discharge of and from the trusts in and by this bequest created in so far as the same apply to or concern such payment or advance or the part or portion of the principal of the said rest residue and remainder sold or dispose of to make such payments or advances or any of them and my said executors shall not nor shall the survivor of them be in any way responsible for or obliged to see to the application of the moneys so paid and advanced.

Eighth In the event of my said daughter dying without leaving a child or children her surviving then I give devise and bequeath so much of the said rest residue and remainder of my estate property and effects as may at the time of her decease be remaining, to my said executors in trust to divide the same in equal shares and proportions to and amongst Gertrude Marion and Jessie Saunders children of the said Alexander J. Saunders and Bridget his wife and John and Edward Scanlan children of Thomas D. Scanlan of St. John's Telegraph Operator and of my sister Kate his wife the child or children of any deceased child to have the parents share equally amongst them.

Ninth. I do hereby nominate and appoint the said Very Reverend Edward F. Walsh and the said Maurice Fenelon as executors of this my will

And lastly I do hereby revoke annul and declare void all wills by me heretofore made. Dated at St. John's this 4th day of May A.D. 1892 (sgd) Patrick Nowlan. Signed by the said Patrick Nowlan as and for his last will and Testament in our presence who in his presence and the presence of each other have hereto set our hands as witnesses on the day and year above written (sgd) Robert J. Kent (sgd) John P. Kent.

      I certify the foregoing to be a correct copy of the last will and Testament of Patrick Nowlan deceased
