Will of Mary Jane Oke
from Newfoundland will books volume 13 pages 362-364 probate year 1926

In re
      MARY JANE OKE.     DECEASED.

THIS IS THE LAST WILL AND TESTAMENT of me MARY JANE OKE, of St. John’s, in the Dominion of Newfoundland, Widow.

I revoke all former wills by me at any time made.

I appoint my son JOHN CARNELL OKE, the EXECUTOR of this my will; and
FIRST I give and bequeath to my said Executor my house and land at present occupied by one Sullivan and situate on the Quidi Vidi Road, in St. John’s, aforesaid, and bounded as follows that is to say:- On the North by my Lane, on the South by property formerly owned by Samuel Carnell now occupied by one Mrs. Hiscock, on the East by the said Quidi Vidi Road, and on the West by other property of my own and hereinafter bequeathed to my son William Charles Oke. TO HOLD the same IN TRUST for my son EDWARD LANGDON OKE during his lifetime and after his death for the benefit of the children of the said Edward Langdon Oke.

SECONDLY. I give, devise and bequeath to my son WILLIAM CHARLES OKE my house and land now occupied by one Bemister and situate off the Quidi Vidi Road, aforesaid, and bounded as follows:- On the North by my said Lane, on the South by property owned formerly by Samuel Carnell, on the East by the land hereinbefore referred to, and on the West by property belonging to Nicholas Collier.

THIRDLY I give and bequeath to my grandson GORDON JEANS OKE my house and land at present occupied by the Reverend Atkinson and situate on the said Quidi Vidi Road and bounded as follows:- On the East by the said Quidi Vidi Road, on the South by property belonging to Martin’s Estate, and on the West and North by property belonging to my said son John Carnell Oke.

FOURTHLY I give and bequeath to my grandson WILLIAM ROBERT OKE CUNNINGHAM the sum of Two hundred Dollars should he be alive at the time of my death but should he predecease me, then it is my will and desire that the bequest hereby made shall form part of the residue of my estate and shall be divided as hereinafter provided for.

FIFTHLY I give, devise and bequeath to my said EXECUTOR all my household furniture, goods, plate, linen, china, glass, pictures, photographs, jewelry and wearing apparel for his own absolute use and benefit.

SIXTHLY I give and bequeath all the rest, residue and remainder of my estate of whatsoever nature and wheresoever situate, after paying all my just debts, funeral and testamentary expenses, to be divided equally between my said sons JOHN CARNELL OKE, EDWARD LANGDON OKE, and WILLIAM CHARLES OKE.

IN WITNESS WHEREOF I have hereunto set my hand this 25th day of November A.D. 1918.

SIGNED by the Testatrix as and for her last will and testament in our presence, who in her presence and in presence of each other have hereunto subscribed our names as witnesses.

      This is a Codicil to the last Will and Testament of me Mary Jane Oke dated the 25th day of November A.D. 1918.

FIRST - I revoke the first and second clauses of my said will.

SECOND - I give devise and bequeath to my Executor my house and land at present occupied by one Sullivan and situate on the Quidi Vidi Road, in St. John’s, aforesaid, and bounded as follows that is to say. Commencing at a point on the said Quidi Vidi Road, and being on the boundary of my land and land formerly belonging to Samuel Carnell and running along the said Road the frontage of the said house thence along the Northern boundary of my said house to a point which would divide my land in two so that the frontages on Colliers Lane shall be equal to one another and the frontages on the Southern side shall also equal one another, allowing however for a right of way or passage way of seven feet wide to run from the said Colliers Lane to the Southern boundary of my lane and which right of way is to be used by the beneficiaries under this bequest in common with the beneficiaries under the following two bequests, thence along the said passage way to the Southern boundary of my land, thence along the said Southern boundary of my land to the place of commencement TO HOLD the same IN TRUST for my son Edward Langdon Oke during his lifetime and after his death for the benefit of the children of the said Edward Langdon Oke share and share alike.

SECONDLY - I give devise and bequeath to my son John Carnell Oke all that piece or parcel of land adjoining the above described land and bounded as follows, on the South by the said land hereinbefore bequeathed to my said son Edward Langdon Oke and his children, on the East by the said quidi Vidi Road, on the North by Colliers Lane and on the West by the said right of way or passage way together with the use of the said passage way in common with the other beneficiaries hereinbefore and hereinafter mentioned

THIRD - I give devise and bequeath to my son William Charles Oke my house and land situate on the South Side of Colliers Lane and bounded as follows that is to say, on the South by property formerly belonging to Samuel Collier on the east by the said right of way or passage way, on the North by the said Colliers lane and on the West by property formerly belonging to Nicholas Collier, together with the right to use the said right of way or passage way in common with the other parties hereinbefore mentioned.

In all other respects I confirm my said will.

IN WITNESS WHEREOF I have hereunto set my hand at St. John’s, aforesaid, this 20th day of November A.D. 1925.

The same having been first read over and explained to the Testatrix who appeared perfectly to understand the same and who signed the same by making her mark thereto in our presence.
