Will of Margaret O'Leary
from Newfoundland will books vol 11 page 422 probate year 1920

In re Margaret O'Leary       deceased

This is the last will and testament of me, Margaret O'Leary, of St. John's, married woman.

  • I desire that my just debts, funeral and testamentary expenses shall first be paid out of my Estate.
  • I give and bequeath to my husband, James O'Leary, all my property of which I may die possessed absolutely.
  • Should my said husband predecease me I desire that my property shall go to my son James O'Leary.
  • I appoint my said husband sole executor of this my last will.

Margaret O'Leary. Signed by the testator in the presence of us both present at the same time who in her presence and in the presence of each other have hereunto subscribed our names as witnesses.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
