Charles Haines

 

Will of Charles Haines
from volume 9 folio 105 and it was entered June 13, 1931.

In the name of God Amen.
I Charles Haines of Middle Bight, South Shore in the electoral district of Harbour Main, Newfoundland Farmer, not being very well in body but of perfect mind and memory do make and ordain this my last will and testament.
First. I give and bequeath to my son Edgar my dwelling house, goods and chattles, stable, outhouses, cellar, all my cultivated  and uncultivated land, horses, cattle, sheep, express, dray, cart, harness, wheels, three sleds, three catamarans, carriage, all my agricultural implements and all loose gear about the place.
All the money that may be possessed of at my death is to be divided in the following manner, my daughters Martha and Maud are to receive fifty dollars apiece and the balance is for my son Edgar.
My outside land is bound on the east by Petten's land- west by Samuel Haines Sr. north by my brother Robert and south by my late brother John's land- My inside partly cultivated land is bound on the south by John Butler of Henry, west by Samuel Butler and John Haines, north by Charles Haines of Henry and east by the river.
And I do hereby utterly disallow revoke and disannul all and every other former testaments, wills, and bequeats by me in anyways before named, willed and bequeathed, ratifying and confirming this, and no other, to be my last will and testament.
In witness whereof I have hereunto set my hand and seal this 15 day of February in the year of our Lord one thousand nine hundred and eleven.

Signed, sealed, published and pronounced and declared by the said Charles Haines as his last will and testament in the presence of us, whoin his persence, and in the presence of each other, have hereunto subscribed our names as witnesses.

Codicil

Be it known unto all these present, that I Charles Haines, of Middle Bight, South Shore in the electrical district of Harbour Main, Newfoundland, Farmer, have made and declared my last will and testament in writing bearing date the 15th day of February in the year of our Lord, one thousand nine hundred and eleven. I the said Charles Haines by this present Codicil do ratify and confirm my last will and testament, and do give and bequeath unto my wife Eliza the sum of one hundred dollars currency ($100.00).
If after my death my wife wished to live with my son Edgar she is at liberty to do so, but if she leaves my home she is to take nothing with her, only what she brought.
All my funeral expenses are to be paid out of my mortality money from the Loyal Orange Association, and if there is any money left my son Edgar is to receive it.
And my will and meaning is that this Codicil adjudged to be a part and parcel of my last will and testament; and that all things therein mentioned and contained be faithfully and truly performed, and as fully and amply in every respect as if the same were so declared and set down in my last will and testament. Witness my hand this 2nd day of February one thausand nine hundred and fifteen.

Note: In 1953 my great grandfather, Edgar Haines, requested a copy of his fathers will, who was Charles Haines. This copy remained in the family bible until it was eventually passed to me. On the front of the document it says the will is located in volume 9 folio 105 and it was entered June 13, 1931.
