THIS IS THE LAST WILL AND TESTAMENT of me ERNEST OUTHWAITE Flat Number 6, 51 ???? Gate Gardens London S.V. 7. Director of Limited Company.
I APPOINT my daughters Mabel Jessie Downing and Gladys Outhwaite and my brother Herbert Outhwaite (hereinafter called "my trustees") to be the executors and trustees of this my will
I GIVE DEVISE BEQUEATH AND APPOINT the whole of my real and personal estate whatsoever and wheresoever unto my trustees UPON TRUST that my trustees shall sell call in and convert into money the same or such part thereof as shall not consist of money and shall out of the moneys produced by such sale calling in and conversion and out of my ready money pay my funeral and testamentary expenses and debts AND shall stand possessed of the residue of the said moneys and the investments for the time being representing the same IN TRUST for my said Daughters Mabel Jessie Downing or Gladys Outhwaite or the survivor of them in equal shares absolutely PROVIDED ALWAYS that if either of my said daughters Mabel Jessie Downing or Gladys Outhwaite shall die in my lifetime leaving a child or children living at my death who being a son or sons attain the age of twenty one years or being a daughter or daughters shall attain that age or marry under that age then and in every such case the last mentioned child or children shall take and if more than one equally between them the share which his her or their parents would have taken under this my will if such parent had survived me.
I DECLARE that the said Herbert Outhwaite notwithstanding his acceptance of the office of a Trustee and Executor of this my will and of his acting in the execution thereof shall be entitled to make the same professional charges and to receive the same pecuniary emolumants and remuneration for all business done by him or by any firm of which he is a member in or about the execution of the trusts and powers of my will and the management and administration of my Trust Estate as if he not being a Trustee or Executor of my will was employed in the winding up thereof.
I DECLARE that my trustees may postpone the sale and conversion of any part of my estate for so long as they shall think fit.
I EMPOWER my Trustees notwithstanding any thing hereinbefore contained at their discretion to continue all or any part of my personal estate in the state or upon the investments in or upon which the same shall be at the time of my death however doubtful or hazardous or limited the description or nature of the property or investment may be
AND I HEREBY REVOKE all former wills made by me and declare this to be my last will and Testament.
