Will of Catharine Ryan

Last will and Testament of
Catharine Ryan of St. John’s
widow deceased

      This is the last will and Testament of me Catharine Ryan of St. John’s widow.

  1. I direct that my just debts funeral and testamentary expenses shall be first paid out of my Estate.
  2. I give devise and bequeath to my son Patrick the dwelling house in which I now live with the land thereto appurtenant including the outhouse and land upon which it is built but subject to the provision for the division of the land hereinafter contained and also subject to to the condition that my son Michael shall have the right to occupy the said house whilst he remain single and unmarried during his lifetime and my daughter Bridget to occupy the said house whilst she remain single and unmarried during her lifetime with my said son Patrick but upon the event of my said son Michael marrying then his interest therein shall cease and determine and upon the marriage of my said daughter her interest therein shall also cease and determine And the said dwelling house and outhouse with the said land appurtenant shall vest absolutely in my said son Patrick Provided nevertheless that the land now held by me situate near the Cross Roads shall at my death be equally divided between my three sons Patrick Michael and James and it is hereby declared that the land just before referred to shall form a portion of Patrick’s share and the land given by deed to James shall form a portion of his share
  3. I give devise and bequeath to my daughter Bridget a piece of land situate on Brine’s Street in the rear of the West End Amusement Hall measuring Twenty five feet frontage on said street and twenty five feet in the rear at the Eastern boundary of said land To hold the same to her for ever.
  4. I give devise and bequeath to my daughter Mary Kelly a piece of land adjoining said piece devised to Bridget on Brine’s Street aforesaid of the same dimensions To hold the same to her forever.
  5. I give devise and bequeath all my right title and interest in and to the remainder of the land on Brine’s Street to all my children aforesaid To hold the same to them as tenants in common in equal shares.
  6. I give and bequeath to my daughter Bridget aforesaid whilst she remains unmarried all my right title and interest in and to the rents issues and profits arising from the lands on Brine’s Street not herein otherwise disposed of and it is my will and desire and I hereby declare that upon the marriage of my said daughter the said rents issues and profits of the said land shall be equally divided amongst my said children including the said Bridget.
  7. I give devise and bequeath to my sons Patrick and Michael all my right title and interest in and to that land situate on the Topsail Road near the farm of Patrick McGrath To hold the same unto them as tenants in common in equal shares.
  8. I hereby appoint my son Patrick Ryan Executor of this my last will and Testament

Dated St. John’s January 17th A.D. 1899. (Sgd) Catharine her X mark Ryan Signed published and declared by the Testatrix by making her mark hereto the said will having first been read over and explained as and for her last will and Testament in the presence of us who in her presence at her request and in the presence of each other have hereunto our hands subscribed as witnesses.
