Will of John Small
from Newfoundland will books volume 12 page 249 probate year 1922

In re JOHN SMALL.       DECEASED.

I, John Small, of Tizzards Harbour in the Dominion of Newfoundland, being of sound mind and memory do make this my last will and testament in manner and form as follows:

  1. I give devise and bequeath all my property real and personal, situate at Tizzards Harbour or elsewhere, of which I may die possessed, unto my two sons George Small and Sandy Small for their sole use and benefit forever.
  2. it is my will that the said devised and bequeathed property be equally divided amongst my two sons above named.
  3. I hereby appoint and constitute Charles White J. P. of Twillingate my Executor whose decision in all matters shall be final, and hereby revoke all other wills by me heretofore made.

In witness whereof I hereunto subscribe my name this 1st day of October A. D. 1920. JOHN his X mark SMALL

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
