Will of Anna M. Stapleton, from Newfoundland will books volume 15 pages 339 & 340 probate year 1931

IN RE.                         DECEASED

Anna M. Stapleton.

I, Anna M. Stapleton spinster, daughter of Capt James Stapleton deceased being of sound mind and memory do make this my last Will and Testament.
I revoke any or all former wills made by me.
I appoint as my executors Mr John MacKey and Mr John Jones both of Carbonear.
I am possessed of a house and land with outhouses situated at Carbonear and bounded as follows: On the west by the Fire Break which is opposite the Public Wharf. On the North by land in the possession of John Bemister. On the east by Goulds Lane. On the South by land owned by H. Howell and the late P. Fox. The above described property has been in the possession of my father and mother and our family for considerably more than forty years. My will is that upon my demise my said executors or whoever may represent them shall sell the said house and property to the best advantage and I give them or either of them in the event of one being seen dead or from any cause being unable to act, full power to give a Bill of Sale to the purchaser or purchasers of the said house and property. And the said Bill of Sale shall be of the same effect as if I myself had given it in my lifetime. My executors shall also sell and dispose of my furniture and household effects to the best advantage. With the proceeds of the sales of the said house and lands and outhouses and furniture etc. together with any and all money or monies that may be in my possession at the time of my death. After paying my lawful debts and funerals expenses, the said executors shall purchase and have erected a monument in our family burying ground in the Roman Catholic cemetery at Carboner and they shall cause an iron railing set in stone to be placed around said burying ground. They shall cause to be cut and inserted on the said monument the following inscription:- Sacred to the memory of Emma S. wife of Capt James Stapleton who died Jan 24th 1872, Capt James Stapleton who died Sept 3rd 1875, Capt John L. Stapleton who died Nov 12th 1875 aged 32, Mary wife of Capt John L. Stapleton who died May 31st 1902, Martha E. daughter of Capt James Stapleton who died Sept 10th 1904, also a suitable inscription registering my own death. And my said executors shall cause a monument and railing to be erected over the grave of my brother Captain John Stapleton who is buried in the cemetery of St. Cecile du Bir below or near Quebec on the St. Lawrence River.
And the balance remaining in the hands of my said executors after all the before mentioned directions shall have been fulfilled and all expenses attending them paid, shall be paid to the Rt Rev Monsgr McCarthy of Carbonear and he shall celebrate Masses for the repose of the souls of my said family and of myself until the said money shall have been expended. My executors shall not be required to give sureties for the performance of their executorship.
Witness my hand at Carboner this thirteenth day of August A.D. one thousand nine hundred and seventeen.

Codicil to my will

Whereas I, Anna M. Stapleton have made by last will and testament bearing date the thirteenth day of August A.D. one thousand nine hundred and seventeen, and have thereby ordered my executors to erect a monument and railing over the grave of my brother the late Capt John Stapleton who is buried in the churchyard of St Cecile du Bir near Quebec.
Now I do by this writing which I hereby declare to be a codicil to my said will, will and order that no such monument or railing be erected in the above named churchyard. I further leave to the Presentation Convent in Carbonear the sum of Two Hundred Dollars.
In witness whereof I have set my hand the Ninth day of June in the year one thousand nine hundred and twenty three.
