Know all men by these presents, That I John Suley Sr. Railway Car repair man. Being of sound and disposing memory, do hereby make this my last will and testament. Revoking any and all wills made by me heretofore.
And I hereby appoint my son Thomas Suley of Whitbourne as my executor of this my last will and reposing special faith confidence and trust in my said executor he is hereby vested by me with full power and discretion in carrying out the intention and purpose of this will according to his own judgement, and I further request that he be not required to give bonds. I hereby devise bequeath and make over unto my wife Hannah Suley, and daughter Charlotte Suley, all my properties situated at Whitbourne of which I shall die possessed, together with all monies either here or at bank or insurance for their sole use (W.J.L.) and benefit during their lifetime, and on the death of both I leave all my property and any monies remaining to my son Thomas Suley of Whitbourne. And he being my executor shall discharge his duties in manner following. That he shall pay all my just debts and Bills and collect bills owing unto me, To look after my property in the interest of my wife and daughter, during their lifetime, also as executor I would wish him to allow my son Ambrose Suley the use of the mill, should he so desire it upon him he Ambrose Suley paying a nominal rental for using the said mill, which amount is to go towards the further support of my wife and daughter. If my son the said Ambrose Suley should be unwilling to work along these lines I hereby give unto my executor the said Thomas Suley, power to sell the machinery and tools and place amounts so obtained to the further use and benefit of my wife Hannah Suley and daughter Charlotte Suley. And be it also known that I do not want any outsiders whether relatives or not, to come and live or make any use of my property, excepting my sons Ambrose and Thomas Suley. And it is my express wish that there be no gambling or card playing on my property at any time.
Also to say further should my wife Hannah Suley refuse to live on the place with my daughter Charlotte, then my executor Thomas Suley shall take full possession of the said property, and conduct it in the interest of my daughter Charlotte during her lifetime and all bequests aforesaid in favour of my wife Hannah Suley shall become void.
In witness whereof I have hereunto set my hand and seal this 29th day of September A.D. 1931 in the presence of Jordan Simmons and J.B. Evans of Whitbourne as witnesses thereto and who in my presence and at my request have signed their names as witnesses.
